My situation:

K1 fiance Visa approved May 2007

Married US citizen in May 2007

Moved to US in May 2007

Green Card in Sept 2007 (yes I know .. warp speed ..)

Worked in Canada until April 2007

Worked in USA from August until now.

Ok, so I was taking a look at Canadian Revenues Agency's list of Rules and Regulations regarding non-residence tax submitting. There is plenty of information out there .. it's just a matter of sorting through it and trying to understand it.

My MAIN question is this: Do I have to submit any of my husbands information??? He is a US citizen and has never lived or worked in Canada. I didn't think I had to until I read this from http://www.cra-arc.gc.ca/E/pub/tg/t4056/t4056-07e.pdf

Enter your spouse or common-law partner’s net world

income for the year. Underneath, enter your spouse or

common-law partner’s net world income for the part of the

year you were a resident of Canada.

Must I really do this or are they referring to a Canadian spouse??? Hmmm.. I was only planning on submitting my T4 for when I worked in Canada in 2007 and my unemployment insurance information.

Help!

I don't believe you report his income as there wouldn't be any eligible spousal exemption or credits for him on your Canadian tax return and you're not going to receive GST or any other Gov. benefit programs now so I can't see where reporting his income would matter

When I did mine I only reported my income and put Lorry in as N/A U.S. Citizen and entered 0 for her income

This came up in another post, but for the life of me I can't find it. From my limited understanding, however, I believe the only purpose a spouse's income is required is so that your non-refundable tax credits are correctly calculated.

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1
