I've noticed that some people send the I-864 and some the I-864EZ. How do you determine which one to send?

I already have most of my paperwork ready, including the forms, as I am using James shortcuts. But I've come across this a couple of times so now I'm wondering which one to use.

Any clarification is greatly appreciated.

USCIS

12/05/05 - Submitted I-130 as LPR

9/20/07 - Became USC

10/03/07 - Submitted I-129

3/4/08 - Sent CSC request to cancel my I-129

3/6/08 - I-130 Approved

NVC

3/14/08 - NVC Assigned Case Number

3/25/08 - DS-3032 & I-864 Bill Generated

3/25/08 - Sent DS-3032 & I-864 Bill (using James' Shortcuts)

3/31/08 - DS-3032 Received in System

3/31/08 - I-864 Generated

3/31/08 - Sent I-864

4/7/08 - I-864 Received in System

4/7/08 - IV Visa Bill Generated

4/12/08 - IV Visa Bill Received

4/15/08 - IV Visa Bill Paid Online!!

I've noticed that some people send the I-864 and some the I-864EZ. How do you determine which one to send?

You can have a look at the guidelines for filling both forms on the uscis.gov website. However as a short explanation the I-864EZ form is a shorter version of the I-864 Affidavit of support and it can be used IF ALL the following conditions apply:

• You are the person who filed or is filing the Form I-130 (Petition for Alien Relative, for a relative being sponsored

• The relative you are sponsoring is the only person listen on the Form I-130 petition

• The income you are using to qualify is based entirely on your salary or pension and is shown on one or more Forms W-2 provided by your employer(s) or former employer(s)

Who MAY NOT use Form I-864EZ:

• The relative you are sponsoring is not the only person immigrating based upon the underlying visa petition

• You filed or are filing a Form I-140, Immigrant Petition for Alien Worker, for the immigrant you are sponsoring

• You are a joint sponsor

• You are a "substitute sponsor" filing because the original I-130 petitioner is deceased

03-07-08 All Cheques cashed!!

03-10-08 NOAs for I-130, I-485, I-765 and I-131 received

03-16-08 NOAs for I-130, I-485, I-765 and I-131 touched

03-27-08 Biometrics Appointment at 2pm (Notice date: 03.11.08)

04-30-08 Received EAD "card production ordered" & AP Approval notices from CRIS (YESSSS!!!!!)

05-06-08 I-765 touched and AP received in the mail!

05-08-08 Received I-765 "approval notice sent" e-mail from CRIS

05-09-08 EAD received in the mail (YIIPPEEYY!!!)

08-22-08 Notice of Action for initial interview received (10-08-08)

10-08-08 AOS Interview in Los Angeles: APPROVED!!!!

10-09-08 I-485 touched! (Card Production Ordered)

10-15-08 NOAs for I-130 (approval notice) and I-485 (welcome letter) received

10-22-08 Green Card finally arrived!!!

Removing of Conditions

07-14-10 Sent I-751 (Via USPS next day delivery) to California Service Center

07-22-10 Received NOA 1

07-30-10 Received NOA 2 (Biometrics appointment on 08-11-10)

08-31-10 NOA for Removal of Conditions approved

09-02-10 Approval letter received

09-03-10 Green Card arrived!!!

what if you aren't using a joint sponsor but you are using your husbands income because yours is zero and it states he doesn't need to file a joint sponsor form? would you be able to use the EZ version?

You will need to use the I-864 if you are including your spouse's income.

If you look at the I-864EZ there is no space to enter your spouses income whereas on the I-864 at item 24 there is.

Also, his/her income needs to continue from the same source when he/she arrives in the U.S. (if the income is foreign).
