UK & US Citizens in UK filing I-130 and G325A

Hi all, my wife is a US citizen and i am British, we are going to apply for my visa in london.

Me and my wife have filled out I-130 and G325A (4 pages each lol).

1st question, on the bottom of the each page 3 tick boxes about what the form is for i.e permanat res, naturlisation or other, i know this sounds stupid but am i applying for permanant straight away or do i type in spouse visa etc.

2nd question, as my wife has lived in the UK since july 07 she hasnt done a tax return, will the last 3 she done in america be acceptable as to be honest she quit working in dec 06, and started again in aug 07.

3rd and final. therefore my wifes parents are also sponsoring us, i am aware that she still has to sign the main sponsor stuff etc, does this mean my mother and father inlaws have to file a g325a also.

So confused about all this i know the consulate will want my wifes tax returns, but the only part i know of so far is sending off our g325a and i-130.

PS. We have a baby girl 5 months old, does she get put on our forms if she is already being filed as a US citizen, because i was under the impression that question meant MY dependants as if i had kids before i married my wife. But the baby is both of ours. and we have another one on the way oct 1st 08.

Oh me and my wife married 5th jan 2007, and she didnt work from jan 07 - aug 07, so when the consulate ask for my wifes tax returns will 04,05,06 be ok as she is still working in uk (aug 07-present but hasnt done any tax returns as she didnt know she had to) cheers everyone

London has it's own checklist, and it's own particular way of doing things. you need to Print out this checklist and follow it's instructions:

You'll notice that London only want the first page of the G-325A and NOT all 4 pages.

The consensus seems to be that on the bottom of the G-325A you tick 'other' and put on the line provided 'I-130 petition'. We did that and have been approved.

You do put your wife and your daughter on Q.17 of the I-130 as it only asks about your family, not about who's immigrating. The word 'dependant' does not appear. I hope your not confusing this with the DS-230. That form is for later in the process.

You won't need to worry about tax returns until your I-130 is approved. So don't stress about that now. When you are going for your interview in a few months, you can just bring a letter explaining that your wife didn't file for 2007 because she wasn't required to as she didn't earn enough to warrant filing. Since your not relying on her income for the financial sponsorship, it doesn't matter.

Thanks thats a great load of worry off my mind.

Only other thing im curious about is if anyone knows what forms my parent in laws needs to file and what paperwork they will need so i have it ready for when i file I-130 and i get a package back i will have everything ready for stage 2, cheers again for your answer

Your wife will have to fill out an I-864, as she is your sponsor. Your wifes parents will also have to fill out an I-864 as Joint Sponsors. If one of their earnings would cover you on the poverty guidelines, then you only need one of them to be your joint sponsor.

All the USCIS checklists and instructions dont clearly relate to everything just overall parts, on the i30 checklist it sounds like they dont need my passport just my wifes and entry clearance stamp to the UK, ill photocopy mine and send it anyway just incase, they really should make a thread on here clearly, thanks again for your help poit, by the way by LA do you mean your going to Lousiana as thats state initials or Los Angeles?

You're right there, they only need a photocopy of your wifes photo page and the page with the entry stamp of her passport. Yours is not necessary.

I agree, there are example forms, but I would have really appreciated a guide to all the forms when I was filling them out. The example forms are all done for K-1 anyway, so I wasn't sure when they applied to me.

Hello All

I just sent in applications to London office. I am the USC and hubby is EU. Been here in UK since 2007 and married from 2000.

question is:

I sent in papers on the 14th March and have not gotten email or anything yet. Before, I have had the papers return due to needing more proof that i was here since 2007 and they came back the same week. Should I have heard something by now or should I take in the Easter Holidays and wait a bit longer???

What ever it was, there haven't been that many workdays since March 14th, so I'm sure there's no need to panic just yet.

Also, London are a little spacey on sending NOA1s to DCF folk. I was freaking when I didn't hear anything for a month after filing. After an email to the Embassy, I got a message back that everything was cool and to wait for them to contact me; in the meantime, I could check processing dates here: http://www.usembassy.org.uk/dhs/uscis/i130filing.html (Check on the right hand bar, under "Processing Times"). When your date comes up, your NOA2 should be on its way. As of today, they're processing I-130s filed on January 7th, so it looks like you've got a bit of time yet.

One good sign is whether they have charged your credit card or cashed your cheque!

the papers were the I 130 for husband and daughter.

How were you notified by the uscis, by email or mail?

I have been checking the Credit Card and nothing yet but I guess there has not been many working days since i posted it.

If his parents are currently married and living together, one parent would fill out the I-864 as the only joint sponsor and include the other parent's income in their household income total. Then the other parent would fill out a I-864A.

If the parents are divorced and both parents' incomes are needed, then it would be a two joint sponsor situation.
