Hi all -

My (now) wife applied for an SSN on February 8th, 21 days before her 90 day K-1 visa expired.

We just got a notice from the Soc. Sec. Office that her appliaction was rejected (on March 18th) because her I-94/K-1 has expired.

We got married within the required 90 days and have filed all of the AOS paperwork and received our NOA1.

Can we just bring a copy of our marriage license and our NOA1 for the I-485 and get her SSN or are we out of luck?

--Frustrated!!!

I-129F

4/27/07: I-129F sent to CSC

4/30/07: I-129F received by CSC

5/23/07: Check cashed

6/22/07: Called CSC (I still had not rec'd the NOA1) and was told to wait 30 more days

6/24/07: Touched (phone call)

7/05/07: Received "replacement" copy of NOA1. NOA 1 = May 21st

9/10/07: Touched!!!

9/10/07: NOA2 - approval via email...113 days after the NOA 1 and 135 days after mailing away the application documents

10/18/07: Documents sent from NVC to Thailand

11/5/07: Packet 3 received

11/6/07: Packet 3 returned

11/28/07: INTERVIEW AND APPROVAL!

12/2/07: Wanwisa arrived in California!

2/23/08: Married!

AOS

3/3/08 - sent off I-485, I-131 and I-765

3/7/08 - NOA 1 for the I-485, I-131 and I-765 and online date of last "touch"

3/26/08 - biometrics appointment = done

5/8/08 - Interview scheduled!

5/8/08 - Green card approved after a 10 minute interview. Will arrive in 2 weeks!!!!

5/19/08 - Green card arrived in the mail!

Note: AP and EAD were approved around May 1st but that's all moot now!

sorry to hear that. Usually you should be fine to apply for SSN when your I-94 is still valid. BUT I do not know what they consider the deadline.

I guess now you have to wait until she got her GC or EAD, which one comes first.

You will have to wait for the greencard or EAD (assuming you filed the I-765) because she is no longer work authorized.

Sorry to say but you left it too late to apply...... if the SSA were not able to verify her K1 status before her 90 days expired then even once they did get verification because the 90 days is passed they can not approve a SSN because she is no longer allowed to work.... Your wife will now have to wait until she has got her EAD (if applied for) or her Greencard....
