Filing K3 while on holiday

I will be traveling to the USA to visit my fiance on the 20th and will be there for 3 months. We are then both flying back here to South Africa to get married. He will be here for 3 weeks and then head back home. What I would like to know is if he can file the initial pettion while I am there on holiday and we are not married? Or would we file for a fiance visa instead? But then would that still be allowed as we will be getting married in September.

Sorry if this all sounds confusing, but I am pretty confused right now.

Timeline

You cannot file for a K-3 visa until you are married. You can apply for a K-1 fiance visa while you are on vacation but must return to SA while it is processed.

Alternatively, you can wait until your married and file the K-3 visa application. Either way you have to wait in South Africa until it is approved.

You can only file for a K3 if you are already married as you will need to include a copy of your marriage certificate.... if you file for a K1 then you cant enter as a wife/husband on a fiance visa....

so you either wait and file for K3 after your wedding or you file for K1 and come to the States and then get married...

Timeline

If you want to speed things up then do this.

Get married the minute you arrive in teh U.S. at city hall. Apply for K 3 the same day. Your i - 130 will come back in ten days or so and then you can send the i 129 in.

You will probably get your NOA2 while you npw husband is in SA for the real wedding.
