Hello all!

I said that I would let you know how the I-765 application went in Orlando. Well......my lawyer was wrong and you can not file for employment authorization at the local immigration office. The lady there told me to send all of my stuff to the Chicago lockbox. Sorry if I got anyone's hopes up :(

I just have a quick question....

If you were approved for your K3 and are applying for your I-765, do you need to provide a $70 money order for fingerprints or just the $180 application fee?

Ok thanks.

I just sent out the application and when I got home I realized that my lawyer was once again WRONG. He told me to make the money order out to USCIS and I was just reading up and saw that it should be made out to the Department of Homeland Security.

GRRRR this is so frustrating. Does anyone know what will happen now? Will they just send my application back as incomplete?

Ok sorry I'm such a basket case today lol just stressed with this EAD application. I was reading the money order can be made out to either the USCIS or Homeland security so I should be good.

Also, my lawyer told me not to enclose a money order for the fingerprints because they did that at the interview. I do remember getting my 2 index fingers scanned while at my K3 interview in Montreal. Do you guys think that is correct or do I need to get that done again? My lawyer doesn't seem to be right very often so I'm afraid he is giving bad advice again.

Can you get rid of your lawyer? Or at least ask him to read some updated immigration information :lol: Sounds like he's reading from the book I got back in 2001 for marriage visas. A lot has changed since then.

For K-1s, my husband was fingerprinted well before (3 months) the interview. Not sure if it's the same for K-3s, although I would assume it is. You need to be finger printed to get the EAD, and if you were finger printed at the interview, you wouldn't get the EAD ahead of the interview.

edited to add: Do what it says on the instruction form that comes with the I-765. If it says send it in with the form (which it did when we filed in November), send it in with the form. You don't want a RFE!

If it's just EAD you do not have to pay for fingerprints!!!!Trust me, I paid for them and got the whole deal back cause they didn't want my money for prints

I think you should contact uscis .. I was informed that on k3 that if you file AOS seperately from EAD you have to pay twice.. Germangel may not have had to due to the fact that she is letting her cr1 run through. I called 3 times to be sure of what to do and decided finally to file both together to avoid 2 bio fees. I took this from the ead guideline:

$180 base fee, plus $70 biometrics services fee if you have not already been fingerprinted for another immigration benefit.

it seems that K3ers don't need to pay the bio fee. I don't know why. I don't think it's because I did CR1 as that was nowhere indicated in my application. I just filed "EAD prior to filing AOS".
