hi,

Good News ... I-130 got approved on 03/17

Bad News.... I-129F got a RFE 03/18

This is very frustuating for me... especially after waiting for 8 months ... getting RFE on I-129F.

my wife lives in Canada, she goes to school there.

Marriage happened in India

I am yet to see the I-129 RFE letter so I donot have enough details.

could I continue to pursue I-130 ?.......

Will the I-130 get routed to Montreal ? or will that be India ?

Pls. advice on what should be my next steps ... I sincerely appreciate any suggestions.

Just wait for your RFE and go from there. Once you complete your RFE submit whatever USCIS is requesting ASAP to further processing your petition. You will receive another letter and/or status in USCIS website stating that the RFE is satistifed once all necessary documents have been fulfilled. Good Luck.

If I submit paper work for RFE , how soon does it get looked at ? ... Do RFE paperwork gets looked at sooner ?....i.e. I am curious if I loose my spot in the waiting line.

Usually, an RFE will be handled within a couple weeks of receiving your answer. Yes, the I-130 would be routed to Montreal as long as your actual NOA1 doesn't say it won't be.

You do know that the standard procedure is to route the K3 interview to the country the marriage took place, right? Was it your plan to have her travel to India for the K3 interview?

No I wouldn't stop anything as with USCIS you don't know what will come first. If you can understand mytimeline then use that as a helpful guide. I had an RFE and sent the evidence the very next day back to them. They just wanted 4 photos 2 of me 2 of my spouse and our biographic informatino on both of us. I don't know what your RFE is for but that was mine! I'm already approved after they recieved my RFE response my papers went to NVC for 1 week then it went to Algiers consulate and waiting for them to send an interview date to my spouse for k3. My I-130 got approved same day as K3. God bless u.

yes, I am aware that K3 gets routed country where the marriage took place, but I was not sure if they route the I-130 to the country of current residence. thank you for that clarification.

So , I can continue to process I-130 in parallel with the I-129F. i.e. both are independent and they both go on in parallel ......is that a fair statement?.

Continue with the I130 is my recomendation. It is approved.

An RFE on an I129f kinda contradicts the I130 approval. If you had all the information for an I130 approval it should get the I129f approved. Maybe something was missing on the form.

I-130 is actually better even though K1 visa is faster, you will spen less for I-130 then k1 visa.

December 7th----NOA2 online

December 14-----NOA2 Hard Copy

December 21-----NVC recieved

December 28-----NVC send to US embassy in Ethiopia

January 8---------US embassy in Ethiopia will recieve

January 11--------Packet 3

February 7 -------Interview

February 7 -------Passed interview

February 12------VISA in hand

February 22------IN the USA

March 1-----------Wedding

March 15----------Sent AOS

July 7 -------------Finger Print

January 27, 2009--Green card approved without interview. It took almost one year though.

Feb 2 -------------Got the green card in the mail

Next: playing the waiting game for the 2 years holding removal

It is a fair statement in your unique case, in that the I-130 was sent to NVC because the I-129F is not yet approved. Had both cases been approved together the policy (that is not followed with 100% consistency) would be to hold the I-130 for AOS and then you'd have been stuck with the K3.

Enough to approve one will not be enough to approve the other, since either only one will get to a Consulate or they will follow separate paths after leaving the service center. Forwarded case files must be complete in every material respect. One can't "borrow" from another.

Neither interview will take place at an Embassy. Montreal and Chenai are both Consulates.

With freaky little exceptions like Hong Kong no being part of China, there is only one "Embassy" of a Nation in any other Nation but there may be multiple Consulates in support of the Embassy's mission. Even when the Consular services are provided inside an Embassy, the K and CR/IR visas we discuss here are adjudicated by the Consular Service's Immigrant Visa Unit, not Embassy Staff.

I'm in the process of packaging my I-129F, and i have a question regarding RFE. what causes them to RFE? should i include anything extra in my I-129F?

Pushbrk, It kind of means as it would seem. If he provided accurate information for his I130 petition, one would assume he followed the directions for the I129f. I state that maybe he missed something on the form.

I am yet to see the physcial I-129's RFE notice ... so I cannot comment on what they are looking for.

As far as submitting documentation is concern, I submitted all the documents as per the instructions ....I am yet to come to terms with the fact they have issued RFE on my I-129 in the first place.
