RFE problems!!!!!

Salamu alaikum !!!

could someone please help me !!!

i ve just received RFE and it says

You MUST provide âcertified copies of all court and police records showing the charges and dispositions for every such conviction. This is required even if your records were sealed or otherwise cleared or if anyone, including a judge, law enforcement officer, or attorney, told you that you no longer have a record.â

although my fiance indicated on the I-129F form that he has never been convicted of the crimes outlined on it, a government search of his records came back that he has been.

does anyone has the same RFE ??

does anyone knows if bad police report affect K1 visa????

Does your fiance know what is on his Police Report?

Is it something he did, or a mistake on his report?

I am sure that a bad police report COULD affect K-1, depending on the nature of the crime.

This is a problem!!!!

I would suggest that your fiance get a police clearance certificate in original form from the authorities in his country that say he has no criminal record. Then forward this onto the NVC.

It may be that there is a FBI name matched with someone else that has his same name.

If I understand correctly, the OP is the beneficiary, and the USC petitioner is the one they are saying has a police record.

Due to IMBRA regulations, he will definitely need to get this cleared up. I'm sorry I can't suggest how to go about this. Have you posted in the IMBRA or K1 forum?

So sorry to hear about this RFE. Your fiance will have to get an official copy of his police record from his local police department or courthouse (or the police record from the city where the crime was committed). If he didn't commit any crime, and it is a mistake, he still needs to address this. Like, Jenn said, maybe in the IMBRA forum someone can give you more detailed advice... or if you are using an immigration attorney he/she might be able to give you advice.

Don't worry, you will resolve this inchallah.

Hi, i'm sorry... i would like to revise my last post.

i just spoke to a friend who was a criminal prosecutor. she thinks that your fiance would have to contact the state police of whatever state he committed the crime in. they would be able to issue "certified copies."

Ask in the IMBRA forum... i'm sure others have gone through this similar situation.

i really hope it works out...
