Hello all, I have a question that may not be totally unique, but I'm not sure what the correct answer is.

My wife Naoko came over on a fiance visa from Japan and we were married a few months later before the vise expired. We are now in the middle of doing all the paperwork for the Adjustment of Status. A few days ago I got orders (I'm in the Air Force) for a new assignment back to Japan. In fact it's back to the same area my wife just left a few months ago :blush:

Anyway does anyone know how all this works? Do we still need to fill an Adjustment of Status now? At a minimum we will be in Japan for 4 years, with plans to stay a few years longer.

You can get an expedite for the AOS, and I know she can expedited citizenship after that (but she may have to stay here to sort that out for a little while after you have to leave...and I don't think you have to do the citizenship part for her to join you). You'd best do the AOS, or otherwise when you return, you'll have to go through K-3 or IR-1.

noa 1: march 2nd, 2007

interview @ tampa, fl office: april 26, 2007

green card received: may 5, 2007

removal of conditions timeline:

03/26/2009 - received in VSC

07/20/2009 - card production ordered!

Hi YGB. Try doing a forum search. I have seen this same issue off and on in the past couple of years so I know you'll find a thread that addresses it. If I recall correctly, I believe that long term out-of-country military assignments are technically still on American "soil", as it were, and the AOS is still applicable. But definitely do a search because I am not certain how this works.

Same here, I would advise a thorough search but I've understood that even if your wife is outside the country but because you are in the military it applies for her AOS. I would file the AOS since this will count for her citizenship or at least for the PR in case she is not interested on filing for USC in the future.

10/24/08: Received Interview Letter

12/08/08: Interview @ 1:00pm. APPROVED!

01/05/09: Oath Ceremony 10:00AM. Now officially a USC!!!
