To fill out NR73 or not to fill out...

Hey everyone.

I'll try to make this short...

I moved out of Canada at the beginning of Dec. 2007.

My mom has taken all my 2007 tax stuff to the accountant, and he informed her that he will process my taxes for 2007, but I need to fill out form NR73, so that moving forward, all my taxes are filed in the States. He said that if I don't, I could still be liable to pay taxes in Canada.

The only ties I have to Canada is a bank account and a student loan and a credit line. The bank account is open to cover the loan fee's.

I have a car registered in my name, but my brother is driving it.

I am also receiving EI until I can find a job.

Do I go ahead and fill out this form NR73, or not. If I do, what happens? If I don't, what happens?

Anyone else in a similar situation?

hmm... ok, I just called Revenue Canada, and they informed me that because of my various ties still with Canada, that it is best to fill out the NR73 form, and take it from there. I have seen others comment on here that they wouldn't do it unless asked for in writing. What is wrong with filling out this form?

If I don't fill out this form, what happens next year at tax time? Do I end up having to file in both Canada and the States?

I spoke to someone at the International tax service this morning. He told me this would be my final yr. filing a Canadian tax return as my leaving Canada taxes would be in the 2007 return

I told him I would still have income each yr. in Canda and he said if I wanted I could continue to file a section 217 each yr. as my pension income would fall into that eligibility and if I thought it would be to my benefit for a refund. Or I could just not file at all after this yr.

If you don't have income in Canada after this yr. I can't see why the accountant would think you would have to file Canadian taxes again

I didnt bother filing a NR 73, just wrote in the date on my tax form (front page) that I ceased to be a resident of Canada and that worked for me!! BUT if ya talk to cassie --which i know she is just dying to type away---she will say that her accountant (which I think is now behind bars?? it is best to fill it out!!

My reasoning is pretty much on pure laziness!! If they want me to fill it out, they will tell me!! I know of others that did not, and they were never contacted, they as well just put in their cease to be a cdn resident date on the Cdn income taxes!

Your probably not wrong either way!! But why deal with more paperwork!! Stand by for cassies rebuttal, keep in mind she lies a lot, well not a lot, just a little,lol Of course she knows Im only kidding!! if it were not for the great Cassie, i would have not known about EI benefits!!

Don't fill out that form unless CRA specifically asks you to. Filing a Leaving Canada return by writing in the date you left Canada on the first page is good enough.
