Hi everyone-

My fiance and I are trying to wrap up all the last forms and document gathering that needs to be done before his interview. The checklist says that we need to get any court records for arrests/convictions/etc. and I'm wondering if that applies to us. I'm not trying to sound stupid - it just seems like getting court records for traffic violations is a bit much and I want to make absolutely sure.

He was arrested for driving on a suspended license well over ten years ago while living in the US. Does this mean we have to try and figure out when this happened and ask the court for any records pertaining to it?

03/18/2007 - Sam Proposed in Ireland

07/01/2007 - Mailed I129F

07/27/2007 - NOA1 - Petition received

12/05/2007 - NOA2 - Petition Approved

01/04/2008 - NVC approved and sent file to London Embassy

01/15/2008 - Case file erroneously sent to Dublin Embassy

01/18/2008 - London Embassy requested case file be returned from Dublin Embassy

02/04/2008 - Faxed Dublin Embassy for status update, Received response that Dublin would fwd case file to London TODAY!

03/07/2008 - Packet 3 finally sent from London

03/24/2008 - Packet 3 returned to Embassy via recorded mail

04/09/2008 - Medical appointment

04/21/2008 - Interview - sent new police cert via SMS 04/28/08

Hi everyone-

If there was an arrest, there is a record. Find at the courthouse all the papers you will need.

okay mayb ei over read the form 129 but it doesnt ask any thing about traffice violation. it asks about 1. violance 2, murder or 3 alochola dn drugs and 3 or n more convictons for drugs and alcohol. if they were asking about trafic violations i missed that part. and i then filled out the form wrong

The questions on I-129F have to do with the US Citizen's criminal record, not the foreign citizen's. The original question has to do with the DS-Forms being submitted to the US embassy for the Visa by the foreign citizen.

Thanks for your help everyone. Yes, I am talking about the DS forms that we are filling out for the foreign fiance at the foreign embassy, which ask about ANY charges, arrests, or convictions, regardless of whether there has been pardon, etc....

We've contacted the location where it occurred and they're trying to dig up files for us.

For future reference, if anybody else runs into this, I've been told that it's quite common for misdemeanor records to be destroyed after ten years, and an immigration attorney suggested that when this is the case, a letter from the courthouse stating something to that effect is what should be taken to the interview.
