Hello,

when you send in an AOS packet, and you get a reseipt notice from the MSC (NBC), will you know where your file went after that?

also, if you have been waiting for over a year, is it possible to ask for a transfer of the case?

it just doesn't seem fair that K-1 AOS people are getting approvals in 3-4 months, and there are I-130 people waiting over 1 year, and then they have to pay the fees all over again to renew their paperwork and EAD, etc.

are the faster timelines because now all the packet goes to the Chicago address? The person I am concerned about sent the packet to her local office, Orlando. It has been 19 months already.....

After the NBC does some processing it goes to your disctrict office. Before Dec 1, 2004 they did go to the district office in Florida.

Trust me, I truly do sympathize with you, but I don't think you can transfer your file unless you move. Each office has jurisdiction over a specific geographic area and that is where your file is adjudicated.

I don't think there is a pattern where K-1 are taking longer and I-130s faster. I am a K-1 too - took 9 months for that to be approved - and now it has been 22 months since we submitted our AOS application and we are still waiting to hear an interview date. I have had AOS biometrics twice and had to renew both my AP and my EAD. Our second anniversary is next month, so I think it has more to do with the backload for your particular area - and possibly the time when it was submitted - than whether it was a K-1 or not.
