You mention your husband's case is complicated but dont say why. The guides here on VJ are very good and he can complete them on his own. If he has any questions he can post them on this site and there are many people who are willing to help. I used an attorney for my K1 before I knew about VJ and he did nothing that I could not have done myself. In fact he hid behind his answering machine during the whole process (Attorney George Sabga from California) and was more of a hindrance than help. I did my adjustment of status (AOS) myself and we just completed our interview with no problems. Good luck to you.

Why is your husband's case complicated. Using a lawyer depends on if you are confident enough or not to do all paperwork by yourself.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

Lawyers can make cases complicated. My lawyer has delayed my case by 6 months already. He had my husband submit the final paperwork for the NVC. My husband paid $100 to ship here, took a month to get here. When I put the paper work together to send to the NVC the lawyer never requested the DS230 form. He has made so many mistakes on my case. I am sure there are great lawyers, but be carefull.

OH i was sending the stuff to the NVC because I fired my lawyer. If he wasn't fired I would love to hear the excuse he would have come up with as to why he did not request the DS230.

Everything happens for a reason.

Oh, I did reply that thread. In this case, a lawyer can not do anything. The OP's husband has to take care of the child support debt issue first or his visa process may not go well.

Does your husband speak english like a native born American? Does he have an education and can read at high school level??? If answer yes to these questions....then he is able to do the forms himself.

Lawyers are damn expensive and they can be just as bad when making mistakes. (The money your husband saves on doing the paperwork himself can be given to his children he does not take care of)

Having a lawyer to do the paperwork for you will not make your case go any faster.

As far as I know, petitions for family-based visas are not dependent upon the US citizen having a passport. The complete nature of your situation is known only you and your husband, and you are completely within your right to not share personal information that has no bearing on your visa journey. You do not need to justify why your husband did not pay child support, nor respond to criticism from those who sit in judgment of your husband. As a newbie, please feel welcome here on VJ and know that most people are supportive and positive!

I think that failure to pay child support to the point where the passport is revoked will have consequences later on in the visa application process. The primary thing it will affect is the I-864, Affidavit of Support, where your husband will need to show evidence that he can support his household at 125% of the poverty line. The issue may also come up during your interview, where again you may be required to show that your husband has *made good* on his back payments. I agree with some previous posts that the Adam Walsh laws may apply, so read up on those.

Because all of the details of your circumstances are known only to you and your husband, only you can decide to hire a lawyer. I've seen here on VJ that, in most cases, a lawyer is not necessary. The guides here on VJ are extremely helpful! Start with your I-130 petition. Read the instructions here on VJ and the ones that accompany the I-130 petition. I'd suggest re-examining your situation in light of all the advice you've been given, and reading all the guides here on VJ. Give it one week and decide then.

Good luck!

:)

I agree with Lurking.......my lawyer also delayed my process by about a month due to a delay in sending my payment in...urggggg!!! they mean well, but they'll never take it as urgently as you will. Now your case may need some professional expertise....up to how you see and feel about it.

Good Luck.....
