Both Petitions approved, but now I want only I-130

Timeline

So can I do that? If you look at my timeline my petitions were just approved last Friday. Can i now cancel my I-129F and just move with the I-130. Actual I know it can be done, but how do I do it? Do I call the NVC?

* Jan 3, 2003 - Met the love of my life

* Oct 18, 2006 - We got Married

I-130:

* Jul 16, 2007 - Sent I-130 to Nebraska Service Center

* Jul 19, 2007 - I know it's sitting in the PO Box today

* Jul 27, 2007 - Check cashed for I-130 Fee

* Aug 2, 2007 - NOA1 Arrived in the mail dated Jul. 25

* Sep 19, 2007 - ~Touch~ Placed with I-129F

* Dec 4, 2007 - ~Touch~ Address Change

* Mar 7, 2008 - ~Touch~

* Mar 13, 2008 - NOA2 Mailed - We got an approval!

* Jun 3, 2008 - Entered into NVC System

*Jun 4, 2008 - DS- 3032 emailed

*Currently waiting to send I-864.

I-129F:

* Sep 6, 2007 - Mailed I-129F to California Service Center

* Sep 10, 2007 - I-129F arrived to Laguna Niguel PO Box

* Sep 17, 2007 - NOA1 Arrived in the mail dated Sep. 12

* Sep 19, 2007 - ~Touch~ Placed with I-130

* Dec 4, 2007 - ~Touch~ Address Change

* Mar 7, 2008 - ~Touch~

* Mar 13, 2008 - NOA2 Mailed - We got an approval!

You file an I-824, paying a $340 fee and wait an unknown number of months for your I-130 to get moving again.

Are you sure you want that?

You file an I-824, paying a $340 fee and wait an unknown number of months for your I-130 to get moving again.

Are you sure you want that?

Why would it delay it? If both petitions are sent to NVC and I send in the Affidavit of Support shouldn't it just move like a regular IV case?

they are not both sent to NCV, the I-129F is sent and the I-130 stays at the USCIS SC so they can use it for when you file AOS

Timeline estimated adjudication on March 4, 2008. It was adjudicated on April 23.

Our I-130 was approved in 258 days.

I-129F

09/oct/2007 - I-129F Packet sent to CSC

10/oct/2007 - I-129F Packet received

12/oct/2007 - NOA1 receipt date

20/oct/2007 - NOA1 received

23/apr/2008 - APPROVED

Timeline estimated adjudication on April 4, 2008. It was adjudicated on April 23.

Our I-129f was approved in 197 days.

NVC

08/may/2008 - replied to my e-mail sent on april 30, saying that our petition has been sent to the consulate.

Consulate

20/JUN/2008 - Interview - APPROVED!!!

AOS

18/mar/2009 - Packet delivered

24/mar/2009 - NOA for AOS and EAD date

25/mar/2009 - Check cashed

15/apr/2009 - Biometrics done

22/may/2009 - EAD approved

It takes time to process the I-864. Not what you think just by sending that fee in and expecting it to move like the K-3 process.

It's the I-824 that is filed to get the petition moving again. I-864 is filed with NVC after the I-130 gets there.

For what seems like the millionth time but I guess only twice in the last week, here's the memo thet set up this fiasco 15 months ago.

I know that they don't send both, but I called USCIS today and requested that both be sent. She said to send an inquiry to NVC to request it and they can send it there.

It takes time to process the I-864. Not what you think just by sending that fee in and expecting it to move like the K-3 process.

I know IV takes longer to process than K3. I am ok with that. I will explain my situation a bit more below.

I may not understand the situation being discussed but the NVC processing fee for the AOS (Affidavit of Support I-864 form) is $70 when the I-130 is forwarded for a CR-1 visa.

Hey Sean, The $380 is the visa bill. It comes after the $70 (or around the same time).

ok so to explain a bit.

1. We filed for K3 so that we could bring my husbands children in on K4's.

2. We also filed K3 so that there would be faster processing and he would be in the US faster.

Now..

1. We are not bringing the kids with us this time because they have not seen their dad since they were 2 and newborn. They talk on the phone, but to come and meet them and then take them away to live with us would be hard on an 8 and 10 year old. We want to go visit them a few times before they come here.

2. I rather have our full interview done in Mexico now and then have my husband able to work right away instead of him waiting 3 months for an EAD with a K3. Then we also have to have a harder interview here in the states.

The processing of an IV at NVC has sped up quite a bit. It use to be a year after the I-130 approval to get an interview in Mexico. It is now down to about 3 - 5 months. I am willing to wait that out now.
