Voluntary Departure and CIMT

Timeline

Ok, my fiance left the US voluntary last year (he had entered illegaly in 2002). A year prior to him leaving he plead guilty to a CIMT. We have been told that the CIMT was off his record (never saw any actual proof of it though). I'm still concerned about it and wonder if maybe they just told him that giving us false hope. So my question is, am I going to have a ton of problems bringing him over on a K-1 and what waivers might need to be filed. Has anyone else been in a situation similar to this?

I'm speaking to a lawyer tomorrow and hope that he can address these questions for me but I just wanted to be prepared for any possible bad news. :unsure:

Our Timeline

October 2002- Met and fell in love

February 4 2004- Julian is born

February 12 2007- Vera is born

March 21 2007- Rodolfo leaves the US (voluntary departure)

April 2 2008- Met with attorney to talk about the case

Need more information like was he arrested, if so thats a record there and if he plead guilty then its recorded also. Did all this go through the courts? Im just trying to get your situation so I can help. I had a misdemeanor for CIMT but it was later dropped in court and worried as hell because this happened before my immigrant visa interview. But you cant lie because they know everything already. Now I did get a hold of an attorney to help me through because I was dead certain i would need a waiver too. Now this might help you to know. It MIGHT be a problem if the crime committed if convicted would amount to more than a year in jail then they look at it more serious. But if its less than a year (like mine wouldve been) then its a misdemeanor even though it fell under CIMT. Dont worry try and give me more information.
