ideas for evidence to show ties to UK?

My fiance is visiting me next week, and I'm started to get increasingly worried about his entry into the US. He comes through Dulles in Washington, and never had any problems before, but this will be the first time traveling after initiating the K1 process. We received our NOA2 approval in March. I've sent him a copy of our approval notice, a letter from me stating the purpose of his visit (to be here for my commissioning into the Air Force, and college graduation) and our intention to see the K1 process though. He can bring recent pay stubs and his mobile phone contract, but other than that, he doesn't have any ties to the UK- he lives with his parents, and has been working for a temp agency, but currently doesn't have any assignment though them so can't get a letter stating his employment and intentions to return.

Any ideas for additional evidence he can bring *just in case* they want more evidence from him at the border? I could be over-worrying, but I want to avoid the worst-case scenario at all costs.

The temp agency should be able to provide a letter saying he's registered with them - and is 'registered'as available AFTER the date of his return.

His return ticket (or if E-ticket then copy of his BOOKED return flight will suffice - its what *I* used when I went at packet 3 stage) is also a good one.

March 10 2006 - NOA2!

March 24 - petition sent to London

April 9th - Pkt 3 rec'd!

May 17th - Pkt 3 signed for at London Embassy

May 24th - Medical

May24th - Pkt 4

June 14th - Interview 10am - APPROVED 1pm!!

June 16th - Visas received in my hot little hands 1pm :)

July 19th - flying to US!

July 27th - Married!! :-)

Aug 7th - Applied for SSN in married name

Aug 9th - SSN received

AS Jaylen said with the letter from the agency and return ticket he should be OK . He can also take the pk3 Letter with him to show that he has to return for his interview in London but honestly it shouldn't come to that :)

I would recommend the letter from the temp agency and for sure his return ticket. It will all come down to who you get at the border. trust me that I KNOW personally !

Also I would like to recommend being honest! As when I came through MSP airport a few weeks after getting our NOA2 I had prepared myself with a bundle of information like your fiance has collected. I never had to show it but was asked directly "and why should I let you through?". To which I told him that we were currently going through the K1 visa process, where we were at with that and that I could show him my proof that I would be returning, I also told him that it wouldn't be worth my while staying in the country because it would mess up our visa and we would be a separated for longer. He asked me lots of questions trying to trip me up, which is why I recommend you be honest with the POE officer. After that he then let me through warning me to make sure that I left the country once my trip was over!

Good luck to your fiance, it's fairly nerve racking going through this when you are halfway through getting your visa!

Nicola,

Good post, the question asked by the ICE officer that you quote puts a proper perspective on the issue.

Most people think only of ties to the home country, which is only part of the story. The full story is ties to the home country v ties to the USA - which are stronger? Especially when there is clear evidence in the form of a petition to the USCIS that a person is preparing to sever their ties with the home country in order to immigrate to the USA.

We're not talking about evidence that would be appropriate for a B visa here. The best evidence is the person themself and how they answer the question that you faced. Whether it's asked directly or not, that's the question that's in the officer's mind.

Exactly! Why put yourself on the government's radar and then try and enter illegally? The whole thing is so absurd. I'll be on tenterooks until Barrie makes it through Immigration on Thursday...

Thanks for all the advice...it really helped set my mind at ease, though I still worried!

As an update to my original concern, my fiance arrived successfully yesterday. The officer didn't even ask him about the K1 visa!! When asked what the purpose of his visit was, my fiance stated that he was here for my graduation. The officer asked how we met, made small talk with my fiance about a British boxer the officer liked, and cracked jokes. He let him through with no problem- I was very surprised he didn't even care to ask about the K1 visa.

I'm glad my fiance was prepared with documents just in case, but so far all our traveling experiences have been positive. Hopefully next time he is here, it will be on a K1 visa :dance:

Oh wow, I was under the impression you cant travel to the US while the 'home' embassey is processing papers etc for the interview...If the process was going to take ages with sydney I was going to fly and spend a couple of weeks with my guy in the US while I waited for the interview etc...as I can't stand the thought of being seperated for months again...

Yeah, some say not to, but there's nothing stating that you can't travel under the VWP during the K1 process... we thought we'd go for it, and it was definitely worth it. Seems like people have been questioned about the status of their visa when they do travel, but we didn't even get that! Everyone gives the disclaimer "they can always turn you away," but it seems to me that from countries like the UK, Australia and Canada, they aren't too worried about illegal immigration... you hear some horror stories on here, but for the *most* part, it's not usually a big problem.
