Need Advice -- Fiance needs to travel to and from the US up until the wedding.

Hi everyone,

I need a little advice. Fortunately, our visa application process is going along well (faster than I anticipated, knock on wood.). We've received our NO2 and I called the NVC and found out that they've forwarded our documents to the Vancouver embassy for processing. My understanding is that they should be contacting my fiance anytime with his next steps.

How long does the process take to get a visa after the embassy receives your package? Ideally, we don't want the visa to be issued until August. Our wedding is September 6th which means that he doesn't want to quit his job and move until then because he can't work until we'd married. We've been seeing each other every month. We don't want to go several months without seeing each other.

My question is two part:

1. If we get the visa now, can he still fly back and forth up until September as long as he has the intention to return? He has a Canadian passport and an Indian one. He could fly on the non-stamped visa passport, but I thinks it's too risky. They store that information somewhere, right? I don't want to get in trouble. Is there a way to still travel to the US and return to Canada, not traveling on the visa?

2. Secondly, is there any way we can request an interview in July or August? I've heard that the Vancouver embassy is pretty nice. I figure it's March now. By the time paperwork is done, it'll be April something. July isn't far away. Has anyone found them to be accomodating? This solution is probably more likely.

It's so hard right now, just not knowing. Please let me know what you think.

First of all, congrats on getting your NOA2!!

For the first question: I'm gonna go with no, he can't go back and forth after the Visa has been approved.

For the second question: I've read that you can write that he is available for the interview after.... (then write when he will be available). Also keep in mind that he doesn't have to leave Canada right after being approved.

First, he cannot work until AOS is complete and I have heard that runs 90 days+. Second, the K-1 visa is a single entry visa so if he got the visa before he wanted to activate it, there is another thread somewhere here about that recently, so I suggest reading up on that. As far as Vancouver goes, theoretically, you could delay the interview but you can't move it up so it would really depend on when your process is complete. Sorry I cant be more help, but I am sure others can.

Another option is to delay in sending back the checklist, OR contact VAn once u get the paperwork and ask if you request an interview date for what you want, if it is feasible. I'm sure if you explain your situation they can be accommodating, since you want a date later on, vice expedited!! Best of luck

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

I'm not sure about a 4 month delay but my hubby put on the packet 3 requested date "any date after February 10th" and we got February 11th :thumbs:

They are pretty flexible when it comes to interview dates from what I've read. But 4 months is quite a while so I would delay on sending back the packet3 (maybe a month?) and then request a date sometime in July when you do send it back.

One of the things you'll need to do, is request an extension of your NOA2 I believe. You're supposed to have your interview within 4 months of your dated NOA2, so if your approval was in February, a July or August interview couldn't happen without an extension. There was a member that just went to Montreal that specifically asked about not using the visa to enter the US until they wanted to activate it. Look at the thread and see the Consulate's response.

Given your information, I would suggest that when you mail Package 3 back, asking for an extension to have your interview at a later date and requesting the specific month.
