I-134 conflicting info?

Hello everyone,

I was reeading on here from someone who seems very knowledgeable about the k-1 and the I-134 and they wrote, " Notarized copies of his or her latest federal income tax return".

Does this mean I must have the copies of my return notarized? I went to H&R Block and I have the copies of my return and w-2, but how would I get their copies they gave me notarized?

1.) I thought that I only needed send return copies and w-2 copies to them and send w2 originals to my fiance?

2.) I am also am above the poverty guidelines by 700$ and it was not a full year of work, should I still have my mom co-sponsor? Does that help me more?

3.) My son is on my divorce decree and listed as resides with father but that has changed since I sent him to live with his mother reason being the school are a lot better in CT than in FL. I did not claim him in 2007 so do I have to put him on the affidavit of support? or leave him off?

1) It is simpler to use simple IRS transcripts, they are free and you can order them from the IRS

2) If you are at or above 125% then you should be fine.

3) NO, since you dont claim on your tax, you do not need to count.

One thing about I-134, the directions included with I-134 are very old, USCIS has no reason to update them since USCIS has no application for that form.

The consulates tend to treat the I-134 like a mini-I-864 as so prefer the same financial evidence as the I-864.

In our case this what the I-134 included.

  • I-134 signed and notarized.

  • SIMPLE Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS http://www.irs.gov/faqs/faq1-6.html

  • Photo copy of IRS form 1040, and W2s for past 3 years (Not necessary if you provide the transcripts)

  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.

  • Photo copies of past month or so of pay stubs up to a few weeks before the interview.
My income was well above the povertyline so I did not include any asset data (LIKE BANK STATEMENTS or property values).

If your income exceeds 125% or (100% for military) of the povertyline when counting yourself, prospective immigrant and any dependents, then don't bother with assets (401K, Bank balance, Stocks etc..), it is just extra un-needed data to provide, the consular officer is most concerned with INCOME.

I've been told different things about claiming children. My fiance has a daughter that he pays child support in cash and he is not even on the birth certificate. He only gets to see her one day a week and he has not claimed his daughter on any of his taxes. Some people still said that we should say that we are a household of 3. Any suggestions?

I would second what Yu and Dan said except in my case I didn't submit 3 copies of tax transcripts. I only submitted the current year 2007 and a non nototarized copy of my 2007 tax return. I did include bank statements (previous month) and bank/saving account information letters and business license because I am self employed. At the interview, Thi wasn't asked nor did they look at my I-134. (I'm sure they checked it before they called her for her interview.)

To Sounthern_Canadian: Your situation is one that is off the books, ie no legal standing in US as I understand it (But I'm not a lawyer!) so his daugther isn't connected to you and him. His support is one of his own choosing much like supporting a child thru one of the children rescues groups you can donate money to. If you want to concrete advice, I would consult a lawyer familiar with these cases.

so you mean, if a husband or fiance has a child but they dont bring the name of the father since theyre not married, it means that the child is not counted in household?

My husband has 2 kids however, his kids doesnt live with him since birth... but he do support them.. Does this 2 kids should be counted as households too?

I think you only need put them on it....

1. if they live with you

2. if he claims them on taxes

That is what I have been told and since I not claim my son I will not have him on my I-134. That will keep us in the household of 2.
