Don´t worry I know that...I was talking about their case...he needs K1 since they already started the whole thing anyway....so if they get tourist visa for to get married that is fraud like I said...ofcourse you can get married in USA when you are studying there or doing whatever....I was talking about his intend to do so prior to arrival to USA ...so there :P

You stated, "getting married on any other type of visa is fraud" It should have said "Getting married and staying on a visitor visa with intent to do so upon entry is fraud"

That's the difference.

I was clear...he said they had this intentions so if they got any other type of visa except K1 it would have been fraud... :P So there :P

Hey there!

Me and my fiance were going to try that but she got denied for a tourist Visa! You can go for it! If you get it there is always a risk that they will say your marriage is a fraud and deport her because they will say you defrauded the us government! This is a very small chance though! If you get the tourist visa make sure you wait a couple months because you have to make it look like she came there just to visit and fell in love with you i know you have bad luck with lawyers but a lawyer would be helpful with this! Its worth a shot!!!

After our engagement we had been mislead by an attorney too. My fiance wanted to be on the safe side and therefore decided to consult an attorney. The attorney told us that I (German) should enter the U.S. as a tourist with visa waiver and get married, he then would take care of the immigration procedure... :devil:

We fixed our wedding date, booked the church, I returned home, resigned my job, terminated the lease, booked tickets, gave away lots of my belongings... Guess how shocked and in pain my fiance and I were when - just by accident - we learnt that the advise we had been given by the attorney was not legal!

For us it was out of question to try to do anything illegal. We cancelled the wedding, instead started the K-1 visa procedure. (Unfortunately at that time we had no idea of visajourney). After 6 months waiting my interview date (and hopefully the visa) is getting close. The waiting was/is not easy. But it is knitting us together even more, and my fiance and I have the peace of heart, which is worth a few months waiting. Also I am proud of my fiance because without hestitation he chose to be honest - I know I can rely on him!

I am telling you this to encourage you... There seems to be no more backlog and the waiting times are getting shorter. It is only a few months and you and your beautiful love can get married with a K-1 visa and without any worries that might burden a young marriage.
