OK, I am moving this to consulates.

There's a load of misconceptions and misinformtion in the thread so far. Let's take it where the OP can get best results.

1. Student loan income can be used. An immigration attorney told me so. That being said, it probably isn't a great idea.

2. New Delhi is very stringent on the I134 and sponsorship requirements. The OP needs to familiarize themselves with this consulate.

3. The I134 is not a contractual document and the sponsor has no liabilities to anyone. The I864 (completed later on for adjustment of status) binds the USC sponsor to the US government for the repayment of any means-tested benefits the immigrant may use.

my fiancee income is 12300 and she started her job this month so she dosent have py stubs now but by the time of my interview she will have couple of paystubs and she a retirment account in a life insurance company but its liquid she can take the money anytime its 5400 and she own her house which worth like 250000 and she own land 16000 and she own another house 50000 and she rent that house for 4500 yearly after expenses so do u think guys we need cosponsor i really need help and if any one can chat with me about it i would appreciate that and if i need a co sponsor should her 73 years old uncle do it he is retired but have a good bank account he was in military so what yall guys think we should do

Im feeling a little discouraged at the moment... My income is under the 125% and i dont have anyone who would be willing to cosponser for me... Is there anybody out there with a similar situation? I know I have to get a second job part time to put me over the 125 but will they consider that sufficent enough if I get the job now? i havent sent out my i-29 yet so i know i have a little time, but by the time i have to send the income stuff out to my fiance I will probably only have a few paystubs to show proof of the second job, it wont even be on last years tax reports ( seeing how i dont even have the second job yet :whistle: )... If someone has been through something like this it would be great to have some insight. thanks alot

Here is my suggestion...

Get a second part time job. On the Affidavit of Support you can provide letters from employers specifying your employment terms (permanent, full-time/part-time, GROSS ANNUAL SALARY).

That should be sufficient for this year (2008).

*Provide a tax return for 2007.

* SPECIAL NOTE:

If your income level for 2007 is below 125% poverty requirements, be prepared for either the NVC asking for a co-sponsor - OR - the Consulate Officer, at the time of interview, to request a Joint Sponsor. Even if you are making enough money in 2008. (It happened to me)

I have a question about cosponsors and instead of posting a seperate topic maybe the answer might be helpful to katie in trying to find a cosponsor.

My question is, what exactly are the legal responsibilties of a cosponsor? Say, for example, on the I-134 the cosponsor stated that they would 'help with financial aid as needed.' What does that mean from a legal perspective?

My guess is that maybe the government just wants to obsolve themselves of any responsibilty for the beneficiary. In other words, Uncle Sam could, for example, use that statement to deny any claims for welfare on behalf of the beneficiary. But, would the government actually take any legal action to force the cosponsor to provide financial assistance and if so, how much? Could the cosponsor be held accountable if the beneficiary defaults on a loan or fails to pay a bill?

It might be easier to find a cosponsor if the person knew that they weren't putting their own financial security at risk.

legal responsibility of a sponser or co-sponser is to assure the GOVT that the benificiary will not claim welfare. You will pay their medical, dental, living expenses etc.

we have a co sponsor a 73 years old military retired uncle with big bank account ( 500000) 2 houses and cds and 2 retirments accounts so should we be ok now with her real state 2 houses and retirment ( 5000 ) and ira ( 10000 ) even if she dosent have a job or pay stubs i was just wondering maybe we dont need to wait for her pay stub now and we can apply with this co sponsor i need advice guys i need to be with her i miss her so much

The best option is co - sponsor.. and the other otpion if any of your friends or relatives believe you ... you can take money from them deposti them in your account... the amount you need to qualify for 125 % + t 1000 Extra... and their money will be in your account if they can trust you... and you give them a check of the same amount.... with the amount and date on it... so they trust you and encahs their money if they feel anything is not right with you.. this is just for security.. so in short you wont have to go out for a loan process and you can tell the embassy that you had given the loan to friends or relatives and they are giving you back

May 8 ,2007- GET NVC Case Number > NOA2.

June 16 ,2007- Get Order from NVC to pay 70$.

November 13, 2009 - Receipt of I-1751 Fee

November 20, 2009 - Arrested on Domestic Battery(Had argument with wife)

December 18, 2009 - Biometrics Completed at 9 am.

January 13, 2010 - Receive I-797E Notice for more evidence

February 16, 2010 - Mail reaches Californa Service Center( Next day of Preseidents Day)

February 19, 2010 - Card Production Ordered. Status now IR1

Hi Everyone! Hope everything is going well for all of you.

Well I have a couple Questions.

I am a full time student and only work part time so I don't get that much income, and for that reason I have not filed my taxes. My mom is going to co sponsor my fiance. So do i fill out the 134 and just put the pay stubs and bank statements and a letter saying why I havent filed taxes?

Also My mom would fill the I134 and she would add the bank statement, original paystubs, and taxes for 2007,2006, 2005. Right?

also where can i get papers notarized?? Maybe you guys can give me an idea!

ty guys for ur help and im sorry for asking alot of questions but i really love her so much need her so much and i want this visa to work out
