So I'm wondering who is really responsible? Should the reservations be responsible to actually tell people what they're buying SHOULD be taxed? Should the consumer already be aware that they should be taxed? I'm wondering which side it falls on, but for right now, it seems like it's falling on the consumer!

So I guess this is a good lesson, either 1. Quit smoking or 2. If you do, don't buy from indian reservations!!

The consumer is responsible. Many states have adopted what is termed as a "usage tax" which requires people to pay taxes in their own state on purchases made out of state. In Illinois the form for this and instructions are included in the normal state income tax form/booklet mailed each hear

What is a use tax?

A use tax is a tax upon the privilege of using tangible personal

property in Illinois. It is designed to distribute the tax burden

fairly among Illinois consumers and to assure fair competition

between Illinois businesses and out-of-state businesses.

Illinois law requires you to pay tax at the Illinois rate when you

buy an item from another state or country to use in Illinois.

a fine - a tax for doing wrong. a tax - a fine for doing well.

So yeah.. My aunt got some flyer in the mail a couple years back, discount cigarettes from an indian reservation. So she bought and bought and bought.. And she bought for my cousin, my other cousin, my mom.. etc.. Cigarettes on Indian reservations are tax free, that is, if you're on the reservation.

So a couple years and many cartons later, she gets a bill in the mail from the State of Michigan, yup, $4,190... to pay back taxes on cigarettes.

1. quit smoking (anyone)

2. ignorance of the law (the tax) is no excuse. Your aunt is responsible for the taxes.

"The fact that we are here today to debate raising America’s debt limit is a sign of leadership failure. It is a sign that the U.S. Government can’t pay its own bills. It is a sign that we now depend on ongoing financial assistance from foreign countries to finance our Government’s reckless fiscal policies."

Gallbladder surgery is so much easier these days with the laproscopic surgery.. I just have a teeny two inch barely noticeable scar just below my boobie line. I was on a really low fat low calorie diet for a long time, and then had a steak on super bowl sunday a few years back.. man that one landed me a trip the hospital!!

Yes but I have had a couple of c-sections so I won't know till I wake up if I had laproscopic or open surgery. I ended up in the Emergency a couple of months ago which is how I found out what was wrong with me so yes low fat since then. I have had another like 4 attacks, only 2 of them really bad, so I am hoping I can get through the next few days unscathed.

I just can't wait to eat something, anything. I mean I miss cheese lol.

Hmm.. this was done through a mail order catalog, though.

She needs to read the fine print then...I have never heard of anything like this ever.

See Native American tribes have been given amnesty from some (or all, not sure) taxes....which includes taxes on cigs. So why the gov't is going after your aunt is really a dilemma.

She claims there was no fine print, in fact, she didn't even know it was an indian reservation until she got the notice today! The suppliers address was NY, NY.

So yeah.. My aunt got some flyer in the mail a couple years back, discount cigarettes from an indian reservation. So she bought and bought and bought.. Never said it was an excuse, was just wondering if a burden fell on the supplier to make some kind of disclaimer about any applicable local taxes.

Hope everything comes out okay... My surgery was fast and quick healing.
