Is it true that if you filed for a K-3 visa after your I-130, you are kicked back in the line???? I applied for K-3 four months after the I-130 since it took that long to get a NOA1 for I-130???

It appears that when the two petitions get put together, USCIS uses the I-129F receipt date as the priority date for both petitions, so yes.

Facts are cheap...knowing how to use them is precious...

It appears that when the two petitions get put together, USCIS uses the I-129F receipt date as the priority date for both petitions, so yes.

But I know of an appllicant not on this site with the same situation and almost same situation excpet at the CSC, and both her applications got approved on the same day.

I've tried searching timelines and it appears, to me at least, that there are people who filed both petitions who have not had their priority date adjusted.

because this is what I was told when I called about 2 weeks ago, but looking how CSC are approving both lately......what they told me does not make sense.....nothing lately make sense!!

You should be approved on both applications in the next couple of days based on your CSC and timing. I've seen many approvals from CSC lately

The standard policy for the last 15 months has been to join the two petitions and approve them the same day using the same adjudicator. While there is no official change in "priority date" in effect the I-129F receipt date is used to determine the priority for processing petitions.

"Priority date" actually means somthing else entirely. It really doesn't mean anything in spouse of USC cases.

Well, yes for the last 15 months the standard procedure has been for one adjudicator to approve both petitions on the same day, then send the I-130 to be held and I-129F to NVC. Doing them together seems to allow USCIS to do their work according to the receipt date of the I-129F.

Sorry for confusing you with reference to "priority date". I didn't mean the official "priority date" which has another meaning not used for USC spouse cases. Since they deal with both cases at once, the judge themselves as if the priority dates for both petitions were the later date.
