Hi,

I have a question that we need help with. My husbands brother was killed yesterday in MX. We are currently awaiting his green card. We had the interview in July and we are pending FBI name check. He came on a K3 visa. In may he was in MExico and we filed the I-601 waiver. It was approved and he reentered on the K3 visa. His I-94 expired in Feb but his visa is good until 2009. So, what can we do. Can he leave and safely come back while the AOS is pending with his K3 visa and expired I-94. PLEASE HELP!! Thanks so much.

K-3 is multi entry it allows leaving and re entering the USA multiple times while it is valid.

Does is matter that his I-94 is expired? It expired Feb. 2008.

Sounds like POE officer made a mistake, the I-94 expiration should have matched the K-3 expiration, but no it does not matter you will turn in the I-94 when exiting and will be issued a new one upon re-entry.
