Hi There!

My K1 visa is already approved and all that my fiance need to do right now is to submit the I-134 and the supporting document. My fiance's Income Tax Returm for 2007 has only been $10,000 instead of 18,000 but it is mainly because he just got back from my country May of 2007 (he has been here in Manila from Nov2006-May2007) and started working again in the USA by July of 2007. So, on his W2 and 2007 Tax Return, it just showed an income from July 2007 - Dec 2007. His salary for that job if annualized is 24,000$.

My fiance also decided to change job this march of 2007 (its because he can save big money from gasoline-i=jhis previous work is far from his home). We consulted an atty and he told us that we would not need a co-sponsor but my fiance should provide 2 letters explaining 1. why his income was below the poverty guideline and 2. why he decided to change jobs.

I would like to verify and ask for second opinion regarding this matter. What else do you think should we do to have astrong documentation

- My fiance's current job right now has an annual income of 19,200 (above poverty guideline)

- His employer can provide an employment letter and pay stabs

-He doesnt have any bank account or assets

Do you think we'll be good with a w2 and the employer letter and pay stabs?

THank you so much and God bless us all!

Psalm 66:20: Praise be to God for he does not reject my prayer or withheld his love from me!

They are more concerned about your petitioner's income rather than assets and bank statements unless your fiance doesn't meet the poverty guidelines & he needs a co sponsor. If your interview schedule will be this year, you need to submit your fiance's 2007 ITR together with the notarized I-134. During my interview I was asked my fiance's 2007 ITR only & the notarized I-134. The interviewer did not ask for any W2s or 1099s though I had the documents with me. My petitioner is self-employed so I did not need the employment letter. In your case I suggest you need to prepare at least 3 years of W2s, letter of employment & pay stubs.
