When he was young, at the age of 5 or so he came on an airline with his parents to the United States to visit his cousins. He did better in school (teachers here don't hit like teachers over there you know). Then his parents decided to stay. Afterwards, his parents adopted him to his uncle. He's not quite sure, but he thinks the adoption failed because when he checked online at USCIS and called them, they said it failed. He tried to request for follow up papers 2 or 3 times but never recieved them (USCUS probably sent them, his uncle is very unorganized). Since a year ago, we've been living with my parents until the last few months; we rented an apartment.

I think you may best benefit if you gather all your immigration related documentation, and have a consultation with a qualified immigration lawyer. Some law firms have free initial consultations...at least it will give you an idea of where you stand.

Are you a US citizen? If so, you're able to petition your husband w/ the I-130 and I485 filed concurrently. Adoption would first have to be taken care of through the local court system, and then the applicable immigrant benefits applied for? Was that portion done? I'd like to ask, how long ago was all this with the adoption? Do you have any papweork attesting to the adoption?

Who tried to request papers from USCIS 2-3 times? What papers were requested?

As push stated...you need to give details before any of us can begin to assist you....it is very important to know these details because the outcome of the options available to you can depend on such a detail.

Does he know his "A number"? Did he ever have a Social Security Number?

He was the one who tried to request for the follow up letters on the adoption. Also he does know his A number and he does have Social Security. However, on it, there is a printing that says he cant work.

Also, when you guys went through this whole process (if you did), whats the medium price range immigration lawyers ask for?

In this case, because your husband was in the US alread, the adoption would first have to be registered and processed locally - through the county he resided in at the time....only then would you file for immigration benefits basedupon that adoption w/ USCIS. What documentation, if any do you have of this adoption?

Not that I'm prying, but wouldn't it be faster if you file for your husband to adjust status based upon his marriage to you? (This is if you are USC, or even Permanent Resident works I think, but I'm not sure what the wait times are there.)

An immigration attorney cost will vary, depending on the services he's asked to perform. If you have a complicated situation, it may cost a significant amount. But, if it is a reputable firm, reputable attorney, there are always ways to negotiate payment so that it does not have to be paid in one lump sum. Your main focus, if you choose to have the assitance of an attorney, is to research and make sure that your lawyer is knowledgeable and competent.

My recent questions were simply to confirm that he entered the US legally. If he has an A number and SSN, USCIS will be able to determine his status easily. As such, I agree. Simply have him apply to adjust status based on a bona fide marriage to a US Citizen. The adoption attempt is of no consequence other than if they see it as an attempt to gain an immigration benefit through fraud.

You might have a difficult time with your bona fides at interview but should eventually prevail if all is as on the up and up.
