March 2008 I-130 Filers?

Actually my husband thinks it may be HIS background check thats holding us up, not mine. If I read the link on adjudication procedures correctly, they check the petitioner as well. My husband is native american and lives on a reservation in North Dakota with its own tribal court system. His step-father (a lawyer for the court) and says that their records don't normally appear in the usual government databases (there's no record of my husband's previous DUI conviction anywhere else), so we're thinking there's probably some red tape USCIS has to work around to avoid stepping on toes. In addition, our marriage certificate is also from the tribal court, so it may be raising a flag as it looks very different from the kind you get from a county court. Seems to me a 5 minute phone call would take care of that one though. Once everything goes through and we get our NOA2 though, we'll certainly have no problem convincing anyone of the validity of our marriage. I mean, would a sworn city girl willingly move to a native reservation in what is probably the most rural of the states if it WASN'T true love?

Well, we can only guess at this point as to why our petitions were left behind, but I do not think these are the reasons. Background checks are instant, and absence of record is a record already, as far as they are concerned. Marriage cert is not a problem too, they deal with ones from all kinds of authorities over the world. I am sure that most applicants can find some reasons to worry, or some traces of skeletons in their closets, but unless it's a serious criminal issue or visa laws violation it should be ok. So do not worry about it, they are more strict with naturalization apps. Also, at this point they are not looking for a validity of marriage, this will be an issue of the interview.

Still most likely they just did not even touch our files, last week when I called I was on hold for 10 minutes while they were looking for it, and right after that we started too see at least some activity within our timeline.

We still might see some activity over the weekend, and hope we all will get done next week!

Our I130 has been approved! We got the NOA2 in the mail yesterday, although the USCIS website still lists our case as pending. I called NVC and they have issued a case number. On step closer! Good luck to everyone else.

Thanks! Even though Kampala has an embassy Ugandans have to go to Nairobi for immigration applications. Its a hassle because you have to travel to Kenya for the medical exam and interview but at least its an excuse to take a trip to the coast. Good luck with your things as well!

Yeah I thought about that too, but quite honestly, risking another week or two is a chance I'm willing to take...even if only for the reassurance that our case has been neither lost nor found to have a major issue.

I understand how you feel. Your husband might want to try calling the CSC via the RFE option, it connects to the CSC directly. That's what I did Jul.17th, and our back hole applications started getting approvals. If he can call and make something up, kind of a reason to call, confirm current address, or something, it might kick the file if it just lying somewhere. You really never know, and it's useless to look for any logic in their actions, it all comes from the top. They make rules and brake them next day, if they even remember them.

Happy Birthday! we are sorry if you did not get your birthday gift that you wanted, but it's on the way I hope.

Oh for cryyyyyyying out loud! Finally get some new action on my case yesterday, and what so they do? Poke around in the I-130, I-485, and I-765 that we filed for me LAST year! Didn't touch the new petition at ALL!

FINALLY !!! :thumbs:

It is a good news! Means most likely that they are compiling and checking all petitions, they supposed to do it during adjudication, to cross check everything. I became a US citizen a few years ago, and I am sure they were digging my old I-400 too.

At least now you know that it is not lost and they are actually working on it. Hopefully it is a matter of days now.

I know most people are getting approvals without a status update on the website, but it appears there have even been a few approvals without even a touch on the day it was approved. While trying to keep my hopes in check so I don't drive myself mad, I'm really wishing that's what happened yesterday and that our approval was mailed out today. But we'll see...

Our approval was without status change, still shows "pending" on USCIS site.

And also we have a reason to believe that actual approval was some time before the touch, HOA2 hard copy was generated on the day of the touch. But our NVC case # for some reason not the date of the case received at NVC, but 2 weeks prior. Makes me think, either they do not assign the case # at NVC, or they assign case # according to the actual approval date?

Either way, one can only guess what they do there. But as long as something moves or being touched it's good.
