March 2008 I-130 Filers?

My husband has informed me that he called today and was more or less told that our background check hasn't come back yet. I have no idea how much processing is involved after the check is complete, but I'm guessing I'm not getting an approval anytime soon. :(

Most likely just the opposite. According to the General Adjudication Procedures from the USCIS website, they run security clearance again right before the adjudication, in addition to the one they run when they receive the file.

So it might actually signal the final steps of the process.

Let's hope for the best, at least someone out there is actually working.

Well, after a good night's sleep I did some research on the background checks, and now I feel sick again. The Immigration Security Check fact sheet (from the USCIS site) indicates "Results of an IBIS check are usually available immediately." So if mine isn't, then obviously something came up on it. Since I've never even seen the inside of a police station or been involved with anything else that would cause a hit, I know it will eventually be resolved and I'll be approved. But meanwhile, further down in the fact sheet, "Resolving pending cases is time-consuming and labor-intensive; some cases legitimately take months or even several years to resolve" just makes my heart sink.

Well, after a good night's sleep I did some research on the background checks, and now I feel sick again. Obviously, it takes a few minutes to do an IBIS check, and probably less than an hour to do the whole adjudication thing.. They take their time though getting to it. In one of the process guides it also says that most of the time "your petition is awaiting its turn". Since HB1 and K1 and EVERYONE else is more important than spouses of citizens, we go last, whenever they feel like they have some free time.

"time consuming"- read they have to actually spend time doing it.

"labor-intensive" - they might have to lift your file and break sweat moving.

"some cases legitimately take months or even several years to resolve" - of course, and some take 30 days.

It's all just a matter of someone there getting the file and and doing the job. I do still think that our files got left behind somehow, someone's vacation, or new on the job, or just missed and left on the shelf, whatever.

Do we have another choice but hope for the soonest? I would not book a ticket yet of course, but things are moving along at least.

I don't understand how a K1 takes priority over an already existing family. Nothing against any of the K1 filers of course, it just seems cruel and poorly prioritized on USCIS's part. I love how they offer an expedite request for hardship cases, but the undue stress and mental anguish and insomnia and ulcers and financial strain of having to maintain two households and pure heartbreak that THEY directly cause us don't count for ####.

That doesn't make too much sense to me either. If you go K1 Visa, sure you get down there faster, but for 90Days you sit on your ### and unless you have a lot of savings it's financially straining and stressful. And when you apply for a CR-1 you get full privileges to work right away but it takes forever to get approved. Don't they want to get contributing members of society in the country faster than non-contributing. I would have went K-1 route too but what's the point if I wasn't able to work or leave the country for 90 days.

So my wife is in the US, I'm in Canada we both work to make our payments and the more time that goes by, the likelihood of retaining the job I had while I was on my TN-1 visa slips away from me. *sigh* I just want to get back to a normal life.

I think that before they qualify to be employed with anything involving immigration, every one of them should have to spend a minimum of one year living apart from their spouse. Maybe then they'd have a heart and actually give a damn about what we're going through and maybe...just MAYBE...do something to help us.

I think that before they qualify to be employed with anything involving immigration, every one of them should have to spend a minimum of one year living apart from their spouse. Maybe then they'd have a heart and actually give a damn about what we're going through and maybe...just MAYBE...do something to help us.

Would be nice.. But slim chance, nobody actually cares who is qualified for what in the government, last few years demonstrate it beyond any doubt.

Sorry for sounding mean and sarcastic lately, but just feel sick of all this.

Seems like the yesterday touch was just a touch, nothing more.. Maybe someone decided to dust our files, clear them of spider web, whatever..

Some approvals today for May petitions, but ours are still in a hole.

I might see that it takes them more than 1 hour to check if my wife is not a spy or a Russian mob boss trying to come to US to launder her vast fortune. But can not understand why applicants from Canada are taking longer than average.. Could it be that they are making sure they are not running a Canadian pharmacies thus undermining US economy?

But again, the USCIS action or inaction defies any logic, so we can only guess, and still be wrong most likely.

Actually my husband thinks it may be HIS background check thats holding us up, not mine. If I read the link on adjudication procedures correctly, they check the petitioner as well. My husband is native american and lives on a reservation in North Dakota with its own tribal court system. His step-father (a lawyer for the court) and says that their records don't normally appear in the usual government databases (there's no record of my husband's previous DUI conviction anywhere else), so we're thinking there's probably some red tape USCIS has to work around to avoid stepping on toes. In addition, our marriage certificate is also from the tribal court, so it may be raising a flag as it looks very different from the kind you get from a county court. Seems to me a 5 minute phone call would take care of that one though. Once everything goes through and we get our NOA2 though, we'll certainly have no problem convincing anyone of the validity of our marriage. I mean, would a sworn city girl willingly move to a native reservation in what is probably the most rural of the states if it WASN'T true love?
