my boyfriend/fiance and i have been planning his permanent move from the UK to the US for sometime now. i am planning on going to law school, them eventually moving back home to New York, i currently live in GA. it makes no sense to go through law school and the BAR and GA, then move to NY.

i know that i have to file in the state i live in and we were planning on filing after i graduate from college in '08. so, if i graduate in '08, move to NY and file would that be an issue. i know i would need a co-sponser, but would s/he have to live in the same state i live in?

ultimately my larger question is, will i be able to move to NY after graduation and still be able to file the K-1?

any tips, suggestions, comments are more than welcome!!

My understanding is that it doesnt matter who the co-sponsor is just so long as they are an American Citizen or LPR and have enough income. It shouldnt matter what state they are in

so it wouldn't matter if i moved and then filed, i was wondering if there was some sort of waiting period.

Nope! You're good to go after you move.

You don't have to live in the same state as the sponsor. My dad was the co-sponsor for my sister's husband, and they live in separate states.

(I guess the women in my family have a thing for importing husbands...)
