Two ways,

You file I-765 and pay a $340 fee before adjusting status.

OR

You file I-485 and I-765 and pay a single fee of $1010.

Some K-3s opt to file the I-765 first and pay the ($340), and wait a bit to then file the I-485 to adjust status, the trick in this case is to file the I-485 less than 1 year after visa medical, but as close to 2nd wedding anniversary as they can. If the I-485 is approved AFTER 2nd wedding anniversary, the immigrants will receive the 10 year green card, saving them the extra hassle of later filing I-751 (And $545) to remove conditions on a 2 year conditional green-card.

In any case the K-3 holder will wait 90 days or more to get EAD to work, one of the many reasons not to do K-3 and just go for the CR-1 immigrant visa.

Thank you, Dan. How do I get a work permit? I understand K3 visa holders are NOT allowed to work unless they get a work permit.

What I told you is how you get the work permit, I-765 is the application for EAD, EAD is Employment Authorization Document AKA Work Permit. You file for it shortly after entry to the USA on the K-3.

This is one of the reasons I like telling people that the CR-1 (I-130 without the I-129F) has advantages, CR-1 results in green-card, which is work authorization.

How do I obtain a work permit after entering on K3? Is it easy to do it w/o hiring a lawyer?

HIII im so happy for u that ur k3 has reached NVC!!! you were one of the first recently isaw who got i129f approved!! im so glad that k3's are getting approved.. you will be with your spouse much quicker than the cr-1. but the disadvantage is waiting for 90 days for ur work permit.. but its ok!! atleast you both will be together... that what counts the most....

now from here it will be smooth sailing.. keep me posted on mumbai consulate.. thanx!!

5-05-08- DS3032 AND AOS fee bill was generated today

5-05-08- paid AOS fee bill $70 online

5-07-08- AOS FEE now says PAID online, can print cover sht.

5-07-08*cald NVC and msg says AOS $recvd

5-12-08-DS3032 EMAIL Accepted

5-13-08*cald NVC and msg now says DS3032 choice of agent has been received.

5-13-08-mailed AOS i864 packet w/printed cover sheet from online payment (certified mail- priority)

5-15-08-AOS packet received by NVC

5-18-08 iv FEE bill invoiced

5-18-08 iv fee $400 paid online

5-20-08-iv fee cleared, able to print covr shet online

5-21-08-mailed DS230 packet to NVC via priority mail

5-29-08 aos ACCEPTED

5-29-08- DS 230 entered in system

6-3-08-cse cmplte.

6-11-08 case left NVC to chennai via DHL

6-16-08 case reached chennai

7-2-08 appt letter received by beneficiary

7-4-08 medical done in chennai

7-28-08 interview- AP for 4-6 weeks (awaiting name chk clearance-told by chenai operator)

8-20-08 chennai forwarded file to DOS- according to inquiry from congressmans office

(also confirmed by DOS)

8-28-08 file reached DOS- told by operator

9-2-08- last update to case,told by DOS

12-12-08 emailed chennai embassy asking status of our case, and got email to send passport..

12-15-08 submitted passport to vfs

12-19-08 VISA ISSUED! in hand!

12-25-08 hubbys arrival! smooth POE!

1-16-09 green card arrives

1-27-09 SSN card in mail

i also got same day approval

and wating that when NVC will recive and issue new number

pls msg me if u will here somthing from NVC

i dont know how much time it will take for rest of process

and how much mony we have to pay and for wt.

do u know any think about DS156 and DS230 when we have file this form and wt is the fee

i need advise for restof process

An immigrant only gets one "A number" but if both cases go to NVC, they'll get separate case numbers. You didn't file an I-129. That's for a worker. Your I-129F will have four months validity but Consular officers routinely extend the validity in four-month increments, as needed.

Further, a single NOA2 will not say anything about another case. Did you mean both NOA2 indicate transfer to NVC? That would be a fairly rare mistake. Are you sure the one for your I-130 mentions NVC?

If your K3 is going to the embassy, you'll have to pay $130 for the DS 156 which is the fee for non-immigrant visa plus the cost of finger prints at the embassy and you have your K3 visa and entry US. In the US when you adjust you status it would cost you another $1010. Lastly, to remove the two year condition you would pay $540. That's it you are done now, and good for 10 years or until apply for the US passport which would cost you another $ 600 something.

Is the CR1 route much better? I'd have preferred that route too like most of you'll here, but the wait is significantly long. :crying::crying::crying:

yes i got both of my petition 129f spouse and 130 approved and transferred to the NVC. and i recived two NOA2 one is for 129f spouse and other is for 130 and on my boty NOA2 it says that both of files is be transferred to NVC.and in i129f they said it valid till july 08

do u think is this ok
