Hi there,

I really need you guys help. I just got an annulment after 1 yr and 8 months of a good faith marriage. I am going to apply for the I-751 by myself I think I have enough evidence.

Any advice of how easy is it gonna be to have it done if I have an annulment?

You need evidence of having commingled your lives, financially and socially, up until the time when whatever event triggered the dissolution of the marriage, or in this case, the annulment.

I'm just curious....isn't an annulment is a judgment that says a marriage never existed? Wouldn't that mean there was no basis for the immigration status in the first place?

Hope someone who knows the nuances of the law can give clarification on this.

Right, but if the alien is not at fault, in other words, if the alien entered the "marriage"with bonafide intent, only to learn that the "marriage" was not legally valid or it was marriage by inducement there are certain situations that USCIS recognises that permits an alien to remove conditions from permanent residency without the USC's participation.

As far as immigration is concerned, iirc, it's treated like a divorce; the foreign spouse just has to show good faith intent upon entering into it. (E.g., grounds for annulment could be, e.g., the USC concealing a drug addiction or a fraud.)

I have prove of a good faith marriage, the thing is when we were filing for divorce the reason why we filed for divorce was that he wanted to have kids right away and we already agreed on waiting 6 yrs, so the problems started and I got tired so I asked him for divorced, he agreed and he told me he was going to take care of everything as long as I agreed on giving him the right for all the goods we bought together. So last week I got the annulment decree instead of the divorce decree and I told him what was going on and he said that in order to have an annulment he said i didnt want to have kids and I tricked him to get married so that means a fraud can get an annulment.

So know I don't know what to do, I don't know if the UCSIS cares about the reason of the annulment of with just the evidence I can get my I-751 or I really need to get a lawyer to fight for a divorce instead of the annulment.

Yes I have a decree already an annulment decree, my ex husband told me he was gonna take care of everything I trusted him and instead of a divorce he filed for an annulment which is harder to get I don't know where he got evidence to prove anything. I asked him and he doesn't wanna tall me a word.

I don't know if it is too late to do something about it, but if this affects more my opportunity to get the permanent residence I would do everything I can to fix it before it is too late.

But if I can do it with the annulment and it is the same I would rather leave all of this in peace.

If you have any concerns about the impact this document might have on successful removal of conditions, then by all means consult an immigration attorney. He or she can see the court's judgment and determine if there is any language within that could compromise your case.

As a general rule, aliens are permitted to self-petition to remove conditions after a marriage has been annuled. The issue in this particular situation is to know exactly what the grounds your ex-husband used with the court to accomplish his interests. Yes, I know you said you trusted him to handle the dissolution of the marriage, but you are the one that can pay a handsome price for any error or option he exercised. A consultation would be wise, if for no other reason than peace of mind.

There is no such thing as an annulment after 1 yr and 8 months of good faith marriage in the USA. Good luck trying to apply by yourself, but you might go see an immigration lawyer first. For it sounds like you have a much more complex situation than you are telling us here. For it is not going to be easy. :whistle:

What ground was the annulment based on? Are you entitled to any alimony?

I would surmise that there would be no alimony after an annulment as the purpose of the annulment is to declare the marriage void ab initio, or as if it had never occurred.
