1. I-864p is the poverty guidelines form. How exactly does this "guide" guide i-134 form?

2. Item 8 on I-134 form has "wholly dependent" and "partial dependent". My parents and I are going to jointly sponsor my fiancee, but we are not sure if we should pick "wholly dependent" or "partial dependent".

3. Is there a sample I-134 online that has been filled out? I found item 10 and 11 very confusing, not sure what the questions are stating.

4. Item 7 can include stocks and bonds, as well as cash surrender value. Do mutual funds count? Any official documents required for it? What about cash surrender value?

1) That form tells you exactly what Gross income minimum amount the the sponsor needs to make in order to sponsor the immigrant.

2) This has to do with persons that the US citizen claims on their IRS return, If you dont claim anyone then dont list anyone.

3) 10 this is the person that you filed the petition for. 11 has mor to do with other NON-Immigrant visas like student or visitor, in those cases the sponsor can specify howmuch and for how long they will sponsor. For K-Visas you can state "N/A K-Visa process for permanent resident"

4) If income exceeds 125% then dont bother with asset data like stocks/bonds etc. Guangzhou is notorious about asking questions about these things, so if you don't list them they wont ask the questions, Keep the I-134 simple.

One thing about I-134, the directions included with I-134 are very old, USCIS has no reason to update them since USCIS has no application for that form.

The consulates tend to treat the I-134 like a mini-I-864 as so prefer the same financial evidence as the I-864.

In our case this what the I-134 included.

  • I-134 signed and notarized.

  • SIMPLE Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS http://www.irs.gov/faqs/faq1-6.html

  • Photo copy of IRS form 1040, and W2s for past 3 years (Not necessary if you provide the transcripts)

  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.

  • Photo copies of past month or so of pay stubs up to a few weeks before the interview.
My income was well above the povertyline so I did not include any asset data (LIKE BANK STATEMENTS or property values).

If your income exceeds 125% or (100% for military) of the povertyline when counting yourself, prospective immigrant and any dependents, then don't bother with assets (401K, Bank balance, Stocks etc..), it is just extra un-needed data to provide, the consular officer is most concerned with INCOME.

Lastly, I highly recommend joining and researching the process on "A Candle For Love" That site has the most extensive info on the US Consulate in China.

Thank you, YuAndDan, from what you said, I reckon as long as we can provide support over 125% of poverty line stated on I-864p, it should be fine?

Correct, GUZ strictly uses the 125% line, though technically the I-134 only requires 100% Edited by YuAndDan

My school has gone completely paperless, so I dont have any pay stubs, will that be a problem?

Also, it sounds like I dont need to collect the pay stubs until shortly before the interview? So I need to know the interview date first before doing anything?

My pay stubs are also paperless, they email them to me in PDF form, I just printed them out.

And, Yes parent need to provide the same types of evidence as the petitioner, that is IRS transcripts, etc...

What Guangzhou will do is look at both I-134 yours, and your parent's and will use the one that exceeds the 125% mark.

Q.10 Your petitioner need's to complete her own I-134 - she is petitioning for you. Your sponsor fills oout a seperate form and will write 'NONE' in this Q

Q.11 you do not have to check either, just write N/A. K1 process for permanent residency

This could be the dumbest question ever, but is it ok if my sponsor gets paid on a weekly basis?

Not stupid...but not sure why it would make a difference? If you have to put a monthly salary somewhere, just mulitply it to get the monthly figure :)
