Yet another I-864 question

Hello Everyone,

I'm trying to prepare myself as much as I can for our CR-1 interview in Naples. I have a question about the affidavit of support, I-864. I didn't make enough money on my last taxes filed as I left America in the middle of 2006 to be with my husband here in Italy, but I DID make some money from the previous months of that year while I was still in America. My question is, does my joint sponsor have to show all of the money required for the 125% or is their income combined with mine? Also, do they have to be responsible for me as well or just themselves, my husband and whoever else in their house at this time?

Dear Erin,

Nope - your income and the joint sponsor income's do not get "added". The joint sponsor needs to go over the 125% by him/herself, and this includes: him/her, any members of his/her family, and the intending immigrant (for household # purposes). The USC (you) are not the joint sponsor responsibility.

The USC (you) are not the joint sponsor responsibility.

To make it clear, only spouses and dependent family members need to be included in the joint sponsor's household size. If an independent sibling for example was living at the same house, they would not be included in the number of household members unless they wanted to include their income and fill out an I-864A.

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly
