Information in guides contradicting? - I130/I485/AOS

Hello,

I am reading and reading guides and instructions here on site over and over as well as what people post in forums. I found that some information in guides contradicts each other. For example, there is no requirement for birth certificate of the spouse for I130 package yet in one of the guides it says its needed as well some people seem to include it.

I am considering filing I130/I485 concurrently and it says in the guide that marriage certificate, passport bio page copy is needed for I485 package whereas USCIS I485 instructions does not require that (for I130/I485 concurrent). Yet, I found some other forum members who post their packages examples and they are including that extra bit of evidence.

I am wondering is it a common sense to send a little more information beyond what is required to USCIS just to be safe?

you said it. I sent every bit of extra info posted here and didn't have an issue, it is better to be safe than sorry. I even sent a certified copy of my wife's and my birth certificate

You are correct. It is contradicting because the instruction on the forms does not explicitly mention to submit birth certificates; however, the adjudicator may make a decision to ask for additional documents such as the birth certificates. Since many VJ members are apprehensive about receiving RFEs, they decided to include documents that are not asked for.

Timeline

Because each one is sent to a different office, have two checks ready. One for the I-130, and one for the I-485.

Ultimately, USCIS will unite the two forms.

To my understanding (and as advised by an immigrations paralegal) there are 3 cheques to send, 1 for the I-130 ($355) and 2 for the I-485 ($930 check in payment of the I-485 and $80 for biometrics).

04-30-08 Received EAD "card production ordered" & AP Approval notices from CRIS (YESSSS!!!!!)

08-31-10 NOA for Removal of Conditions approved

09-02-10 Approval letter received

09-03-10 Green Card arrived!!!

No. Just two. The check for 1010 includes the biometrics fee. Both made payable to Dept. of Homeland security. On the I-485 instruction sheets indicate that 1010 will be the only thing you need to mail it since it includes the biometric fee.

I sent 3 and they cashed them all. So I guess it doesn't make a difference. However I was advised by a paralegal to write 3 and specify on the cheques what the payment was for. They have all been cashed and I have already got the NOAs, so I guess it doesn't matter if you write 2 or 3, since the aforementioned $930 plus $80 belong to the I-485 application.
