Referring to the USCIS Public Notice of Nov 14, 2006

http://www.uscis.gov/files/pressrelease/PN_i-129f.pdf

it clearly states that "USCIS will continue to forward

approved Form I-129F (K-3) petitions to the National

Visa Center (NVC) for consular processing. However,

it will retain approved Form I-130 petitions". This clearly

indicates that the I-130 then does not get a NVC case

number, or? But wait, see, while my I-129F remains

unapproved since Sept last year, my I-130 apparently

has been with NVC since it was approved Sept as well,

because I do have a NVC case number. Or do all approved

I-130 petitions receive a NVC case number, regardless

where they are retained? I am just trying to back track

what has been going on with my applications.

I think that if your I-130 has been aproved so long ago, you can forget about the I-129F.

19/sep/2007 - NOA1 receipt date

25/sep/2007 - NOA1 arrived

23/apr/2008 - APPROVED

Timeline estimated adjudication on March 4, 2008. It was adjudicated on April 23.

Our I-130 was approved in 258 days.

I-129F

09/oct/2007 - I-129F Packet sent to CSC

10/oct/2007 - I-129F Packet received

12/oct/2007 - NOA1 receipt date

20/oct/2007 - NOA1 received

23/apr/2008 - APPROVED

Timeline estimated adjudication on April 4, 2008. It was adjudicated on April 23.

Our I-129f was approved in 197 days.

NVC

08/may/2008 - replied to my e-mail sent on april 30, saying that our petition has been sent to the consulate.

20/JUN/2008 - Interview - APPROVED!!!

AOS

18/mar/2009 - Packet delivered

24/mar/2009 - NOA for AOS and EAD date

25/mar/2009 - Check cashed

15/apr/2009 - Biometrics done

22/may/2009 - EAD approved

Retained I-130 petitions never get an NVC case number. If your two cases were never put together this procedure could not be followed. If your I-130 was approved before your I-129F was received, the I-129F can no longer be approved. One requirement for processing an I-129F for spouse is that an I-130 is still pending with USCIS.

Facts are cheap...knowing how to use them is precious...
