I need someone to shine a light at the end of this tunnel. I don't usually post here but I'm always reading. As you can see per my timeline, we have been stuck in this dance for too long. We send in my husband's I485 end of 2005, and he has been stuck in the FBI name check for I don't know how long but a USCIS agent confirmed on June of 06' that he had already been submitted for an name check and that it was all that was pending. I had been sending emails and getting replies stating the same thing for over a year until the agent said that I would now have to call and make an inquiry on his case. I was patient and I finally did it on Jan 08, received a letter on 19th of January of 08 stating the same thing... still pending, so when I heard the news about the policy change I was thrilled, I read on the USCIS site that we should wait until the 10th of March to call so I called on the 11th, to my surprise they said they couldn't do anything eventhough of the new policy because of the inquiry they performed in January and it "clearly states on the letter that you must wait 6 months" to inquire about the case again.

I'm stuck and don't know what else to do because they said that the letter I received overrulled the new policy in effect, which makes no sence because the memo went out on February, after the inquiry was done on his case. If that means anything to anyone or you know of something else I could do... please turn the light on...

Any comments or suggestions will be greatly appreciated...

I got the same message at first...but i called a few times and then at the end an agent told me to wait 90 days...somehow i was not confident in this response.

I also inquired with my senator's office who say they have heard from uscis that my checks are "complete" and i am in a queue waiting for an interview...hopefully you will hear something...I would suggest you go to a senator and then maybe call uscis later this week. ask WHY the 180 days not apply to you?

Temporary EAD given for 1 month ONLY b/c of Infopass appt: 5/1/2006

Went back to renew EAD through Infopass: EAD card was not given "due to reasons we can't disclose"

5/3/2007: Confirmation that EAD is delayed due to background checks. (started to use the senator, ombudsman and was just a royal pain in the neck)

5/30/2007: EAD production ordered (after over 400 days of waiting!!! woo hoo!)

AOS Interview: 5/12/2008!!! FINALLLYYYYYYYYYYYYYYYYYYY!!!!!!!!!!!!!!!!!!!!!!

7/29/2008: card production ordered...918 days..can't wait to see that card!

Thank you for your advice. It is a little hard in my case since my husband gets frustrated everytime we get an answer like that and I can't inquire on the case my self so I have to have him on the line. I will try with the senator, but if you hear of anything else please keep me posted.
