Well, our case is different because he was in the US illegally from 2002-2007 (a fact I didn't know until much later) and we have two children. He wasn't deported out of the country but left voluntary. The judge we spoke to let him stay in the US until our daughter was born and told him that he shouldn't have any issues getting a Visa to enter the US. I'm just concerned that something might go wrong or that that might get in the way. I need him here to help rasie our children and I am so nervous that I'm going to mess something up.

October 2002- Met and fell in love

February 4 2004- Julian is born

February 12 2007- Vera is born

March 21 2007- Rodolfo leaves the US (voluntary departure)

April 2 2008- Met with attorney to talk about the case

If you feel like it is too hard to complete the paperwork required, then hire someone to do it for you.

However, I would recommend that you do it yourself. It will just require patience and determination. My petition took about a two months to get perfected and put together neatly so there wouldn't be any problems and so far it has worked out and I have saved a lot of money.

So the decision is really based on how determined you are. The paperwork is really doable, especially when you can rely on Visa journey as a backbone to get started.

Edit Note: I just read your more recent post. Well, that is tough, honestly I don't think an attorney would help a lot, but with a special case it might. Tough call. If it was me I would still do the paperwork on my own. An attorney will just put the papers on the shelf and pocket the money not putting your petition in any sort of importance. Where as if you do it then you know for sure that if you put your heart and soul into it then it really will go through.

With that being the case, an immigration attorney would be a good move. Research them though, make sure you get a good one.

With that being the case, an immigration attorney would be a good move. Research them though, make sure you get a good one.

I've been looking for one who might offer a free consult or something (it's been very hard to find an attorney like that lol).

Very well said rebbecajo. My fiancee and I decided to hire a lawyer and did not regret getting one. Why? Cuz we are both busy. My fiancee doesnt have the time to do search in the net. He is busy working for our future... so that he will meet the above 125% poverty line income requirement. I on the other hand is busy too plus I have a son who needs quality time from me. Ive posted questions here in VJ, but no one bothered to make a reply. The replies I get are thank yous from people I congratulated. At the end of the day, its still our lawayer who we can rely for questions... and if ever we face a problem with our petition, all the vjers could do is say... we are sorry and will pray for you.

I'm just jealous that some people can afford a lawyer, and make multiple visits to their SO, on top of all the visa process fees. If I could afford a lawyer, I'd be using that money to go and see my fiancee, or saving it just incase we need it later.

In that case you probably should get one, because it could get tricky. Do you have family or anyone that could help you pay for a lawyer? I know this wont mean a lot, but I wish you the best!

Most lawyers take payments. Especially the ethical ones who aren't desperate to make a fee.

Yeah, this is definitely a case where a lawyer is going to be the way to go. Make absolutely sure that the lawyer you choose specializes in immigration and has experience with cases like yours. Best of luck to you!

No I'm not. I am the office manager of a small law firm, though. Real estate and civil litigation - not immigration.

I wanted to be an attorney, but seven years of schooling scared me. That's code for - I was too lazy.

And really, since I've spent the last 15 years of my life around lawyers, I don't think I'm a quick enough study to have made a good one. Really good attornies have amazing 'powers of comprehension' and can absorb a lot of data really quickly. I have to pour over things for them to make sense to me.
