http://turbotax.intuit.com/ ya there is a free turbotax edition, I do belive one has to make under a certain amount of $$$. And I would bet the free edition doesnt have all the bell and whistles. I just bought the deluxe version at Costco. Whats up with some editions only having the federal software?? then paying extra for State!! idiots!!

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

Ok folks, so I talked to our joint-sponsor who is an accountant about the whole tax thing. He was a bit of a "well, you need to learn and I really don't think immigration NEEDS joint returns" as in 'eff off'. Quite condescending the MoFo (I was quite pizzed off, mind you), but did got me thinking.

So, according to the man, who I have to admit knows his biz, if we file "married filing jointly", THEN we need the darn foreign tax credit and report ALL the year's income.

If we file "married filing separately" we do not need the tax credit, and we report just US income.

This of course adds to my insanity and confusion. So tell me folks:

Does USCIS will demand joint returns when we remove conditions?

I would much rather file the quick way and get it over with. And all other pieces of wisdom are welcome.

I doubt it's required for removal of conditions. But really the 2555EZ is pretty simple. And unless UofA is paying their grad students a heaping pile more than UNM, you won't need to mess with the foreign tax credit because just excluding you income will make it possible to get back all the income tax you paid last year to the US.

Gave up on ridiculously long US process-started Canadian

12/4/04 submitted app

LSS app returned because of missed signatures, lost in transit, resubmitted in June

9/28/05 landed, yippie

10/4/05 fly back to US to "finish up Master's" lose mind and switch to PhD

Damn it back to the US process

3/something/2005 finally get NOA2, no idea why it took so long

4/15/07 get case approval from NVC

8/9/07 Montreal here we come

10/14/07 hubby activated his visa

I was not a grad student, and the college I taught at did pay a handsome amount for my services..... and B was on teaching leave, so no income.

Len I'm missing something. If Bren didn't make any money last year, I can't see why you wouldn't want to file jointly and get the higher deduction. However, if you are trying not to declare your Canadian earned income-I guess that would make some sense. Have Bren file for the whole year-since he's a citizen I think that he has to. and you just file for the 1.5 months that you were here?? am I on the right track? regardless-check what your tax burden would be if you filed jointly and exclude (with the 2555) the first $80,000 that you combined earned in Canada

You're on the right track. I will play with the numbers over the week and see what the blip we decide. I still wonder about USCIS wanting joint returns for Removal of Conditions.

Dont worry about it!! They dont put tax cheaters in with the same Jail cell as the hard timers!!!
