Hi list,

I have sent my I-130 petition on Sep 12th and after 4 months on Jan 24th 2008 I received NOA1, in the mean time my wife was getting really impatient and we lost trust in each other. I was so frusrated and sent a letter to USCIS to withdraw my petition which is a big foolish mistake. Is is possible to send USCIS another request to continue the process or is it too late?.

Anyone was in this kind of situation? please help!!!!!!!!!.

If the letter you sent was sufficient to withdraw the petition, then it is unlikely you can un-withdraw it. I suspect you'll be filing again but it wouldn't hurt to make an infopass appointment and ask.

Facts are cheap...knowing how to use them is precious...

08/11/08 Received approval email (after 7 months and 3 days...Waiting)

08/15/08 Received NOA2 hardcopy

NVC Journey

08/13/08 NVC case# assigned

08/19/08 DS-3032 e mail sent and got auto response

08/20/08 Received IIN#(one nice rep gave me number)

08/22/08 paid I-864 bill online

08/23/08 I-864 bill status "PAID" online(saturday) but AVR message says " case number assigned ....blah

08/23/08 Printed out I-864 package online and Barcode sheet

08/25/08 I-864 package sent overnight

08/25/08 DS3032 Hardcopy sent by express mail (Hopefully they accept it ..But AVR says AOS fee received/paid on 08/23/08)

08/26/08 I-864 package received per USPS

08/28/08 I-864 package entered into NVC system

08/27/08 NVC accepted DS-3032 (But AVR does not say that)

08/28/08 IV bill generated ( still AVR does NOT say that) but online INVOICE says "NOT PAID"

08/28/08 IV bill paid online "IN PROCESS" status

08/29/08 IV bill "PAID" status (AVR says , they received DS3032)

08/29/08 DS-230 generated

09/02/08 DS-230 and required documents mailed

09/03/08 DS-230 form arrives at NVC per usps

09/04/08 DS-230 information entered into NVC system

09/15/08 CASE COMPLETE(32 days no RFE)

10/15/08 sent to consulate

11/10/08 Medical PASSED

Not yet, I just sent the application last week. Is it possible that they may send a enquriry about this and that time I have a chance to explain them to continue the process?

Our k1 was denied then we married and sent the application for K3.

Why was your K-1 denied? Is the K-1 application completely 'closed'...as in have you received communication from USCIS to that extent? It is important that you verify that your K-1 is completely closed as/per USCIS before a new petition is filed for the same beneficiary.

Unfortunately, once you send in communication stating you want to withdraw the petition, it is almost impossible to 'intercept' the communication and un-withdraw your application. Once USCIS receives your letter, your petition would be marked 'withdrawn'....I don't know of a way in which you can then re-open said petition. You will have to re-file.

Also, an I-130 is not an application for a K3 visa. It is a "petition" which when approved will allow your spouse to "apply" for a CR1, not K3 visa.

ROBERT ........I THINK you need to reapply and wait in line ...like us for cr1 or k3 ....just go through guides &flow chart carefully..............and ask for ... :help::help::help::help::help: here

because it was returned and we were told it expired and we were free to file again so i just file the cr1

When did you send the letter withdrawing the petition?

I know that's what I meant actually CR1 not K3. Petition was received by them on Sep 13th and the letter to withdraw the petition was sent last week.
