Extremely worried about visiting USA

Hello everyone, I recently got married to a USC and very much in love. =) I am here in Malaysia and had just recently gotten a tourist Visa (single entry) and I had bought a ticket to see him within this month. I have no intention of staying in the USA and I am just so worried that I won't have enough proof to show this intention. My family lives here and my husband is still in school (finishing up his Masters).Other than the return ticket, I am not sure what else I can show proof that my intention is just to visit him and his family (i had never met his family). I have stayed in the US before for 6 years. (My dad works for foreign affairs). I am just no nervous about the Port of Entry and if they would not let me see my husband. What would be the reason for the POE to deny entry to begin with?.. well I hope I get some answers to let me ease my mind. Thank you. (We haven't filed for the K3 Visa yet and this trip is really just to meet the inlaws)

I would answer their questions honestly, but volunteer nothing that they dont ask for. The more nervous you are the more in depth their questions are likely to be, so try and relax a little. I have noticed that when I am feeling stressed, US Immigration even gives me a difficult time and I am a USC. I think they must be trained to pick up on stress and see it as a sign that you are up to something.

Do you have a job? go to school? have a leased apartment? anything that you are *committed* to? Having proof of these might help. You might walk right thru with no worries, you might get someone having a bad day, it is really a ####### shoot. For example, when I went to visit my (then) fiance in November, I was grilled for several minutes with all sorts of random questions (and the guy had a mean look on his face! he asked me details about every place I was staying, people's names etc); when I went back for our wedding, I was petrified, the lady said "reason for visit" I said "i'm getting married" she said "OH have a nice time".

Your question about their reason for denying would be "immigrant intent". They will assume if you don't have ties to your country (as I listed in the first sentence) that you're going to try and stay.

01-06 - I-130, K3 shortly after

04-06 - switched to Canada Immigration

07-06 - Moved to Canada (PR almost complete)

07-06 - Changed again, back to US imm.

09-06 - Landed as Canadian PR

10-06 - DCF Toronto, Approved in 1.5 hrs!

11-06 - Interview Montreal (success!)

10-05-06 DCF in Toronto - Approved

10-19-06 Packet 3 received & sent back

10-20-06 Montreal receives P3

11-03-06 Packet 4 received

11-22-06 Interview / Visa approved

YAY!! We can take a break from this madness until Citizenship.

Thank you so much for replying, but I don't have a job at this moment because it will be very difficult for me to get days leave if I do. Other than the return ticket I am not sure what else I can show. How long did you get to stay when you were visiting your guy?

I entered the US january 2005 to visit my now husband for the first time. At that time I had no idea of having to prove ties to my own country. I was on holidays. We then got married.......I came back here and we started the visa journey. In hindsight should I have had evidence to show ties, yes. But how many people out there are like myself and many others that have absolutely no idea of doing this, and then subsequently enter without any difficulties. Thats not to say by any means that you wont be asked to show evidence. Knowing what I do now, there is always a risk of being denied entry regardless of whether one has a fiance, spouse or is just a visitor on holidays etc. Every visitor to the US is looked on as an intending immigrant. There is no petition yet in progress, you have a visitors visa, so just answer honestly if asked any questions and as has been said, dont offer extra information that is not asked of you. You are visiting friends unless they ask you specific questions, just dont lie or it will come back and bit you in the a$$.

Hiya...I think you need to relax. I am an american citizen and I can remember last January 2005 after visiting my fiance in England for the first time, when I went back I was really upset. I mean really, I had to leave the love of my life. When I got to customs even I was given a hard time which I couldnt understand. I AM AMERICAN LOL!!! The same goes for when I came here to the UK. The first time I went through Gatwick and I was given such a hard time. I was nervous and they could see that. They even asked me what kind of relationship I had and was it a sexual one?!!! Then when I came back in May of 2005, I went through Manchester (which isnt as big as Gatwick and Heathrow) and I had no problems what so ever. And this time I had more to worry about because I was staying longer this time. But I was just honest with them and said that I was here visitin my fiance and was staying for 3 months. She told me have a good time and that was it. In my opinion, I do think that it does depend on the airport that you go through and again, how your demeanor is. Just try and stay relaxed...I know it is easier said than done, but when you get through, hopefully you will be able to say that it wasnt as bad as you thought. Btw..if you have a visitor visa, I have been told that you cant be denied entry, but they can still grill you.

Btw..if you have a visitor visa, I have been told that you cant be denied entry, but they can still grill you.

Sorry, but they definitely CAN deny you entry with a VW. Heck, they can deny you entry with a K1, K3 or CR-1 visa if they so wish. Not that they offen do, just that they can. The officers at the POE are all powerful.

Totally aside from this question, but before you file for a K-3 visa, you should investigate your husband coming to visit *you* and filing his petition in KL; they will usually allow this for USCs who are not normally resident there and you can apply for an have your visa in a very short amount of time.

I have a K-3 in process and was informed at POE that there was no possibility of entering the US as the I-130 is immigrant intent in itself. After applying for a visitor visa I was told exactly the same thing and that my spouse should visit me. I want to know how you got a visitor visa when you have a spousal visa.

Incidentally if you have a valid visa you should be allowed entry - bring proof of residence, employment and bank statements.

While i was going through the visa process i visited 2 or 3 times, & had no problems at all, I told when asked about the immigration process, 1 time the POE officer asked if i had any documents to show i was infact going through visa process, so i showed him my NOA1!!.he was cool & said i was ood to go :thumbs: .i had also taken morgage account etc too to show ties back to the UK!!

26-June-2006- Social Security# arrived in the mail....YAY!!
