PLEASE Help advice needed ASAP!!!

I called USCIS today. They said my I-130 & my I-129F are in the file room for K-3's. The lady was nice. She said that my I-130 should have been approved a long time ago but, it was paired with the I-129F. She said the K-3 will take much longer to process and I should in her opinion withraw the K-3 and go for the CR1. It is a much better option. She said to send a letter withdrawing the K-3 then they would approve the I-130 since it is over due for approval.

A problem I am having is I hired a lawyer that strictly only does K-3's. She will not help me any further if I withdraw the I-129F. The CR1 route seems better because all will be over with once completed.

What should I do? What is your experiences with each one?

I need all the advice I can get.

Timeline

If your attorney cannot handle a CR-1 but can do a K-3, I think your attorney is a waste of money. I would suggest you read the guides first and determining if you can finish out the process without your attorney. I would suggest withdrawing the K-3 as historically, they are not finalized that much faster than a CR-1 anyway.

bosa, USCIS may process the CR1 just as fast or even faster than the K3, but the woman who spoke to you did not take into consideration that a CR1 application might take 130 days to go through NVC while the K3 goes through in about a month. Also, you should research how long it takes your consulate to schedule an interview for a CR1. In some contries, the interview waits for the CR1 can be 5 months longer than K3

so think nice and long before you make that choice, specialy now that K3 is showing good indications that it is alive and well

If I had to go through the process all over again, I would have taken the CR-1 route. It is a better visa. Your spouse will receive social security card in less time than the K-3. In addition, no work permit is required. I used a lawyer, and that was the biggest waste of money. VJ was more helpful than any thing.

Yes, honestly you do not need a lawyer. Go with CR-1. It is much better, smoother, and you are already approved! All you have to do is fill out forms with information you already knows. Many very inexperienced people are doing it themselves with no porblem. Just come on VJ and see the directions for your next steps, sample forms, live help. Do not waste your money on a lawayer, go with the CR-1 and it is a very smooth process if there is not name check problems after the interview, in your case the country is not middle eastern you will not even have a problem with that. Next you will e-mail about you being choice of agent, the case will be sent to NVC, you will get packets 3 then 4 and then interview date issued, its not to difficult. I did a CR-1. It went well, I wish for us to get the visa, the embassy called my husband back after a few months of name checks.

Thank you for your help. My I-130 has not been approved yet. I was told if I withdraw my I-129F they would pull the I-130 & approve it within a month. I already have a lawyer who filed my paperwork. If I cancel the I-129F the I-130 information will be sent to my lawyer since she is named as agent right? My lawyer does not do CR1's. I do not know what to do.

I believe that petitions will speed up some, very soon, since they appear to be over the July flood.

You're actually very close to approval for K3...

I'd wait it out.... If you try to change things now, you take a chance on increasing delays or (God Forbid) other problems.

Thanks I think you are absolutely correct. Although I did request that my Congressman's office contact USCIS on the status. We will see what happens from here.

I would not withdraw the I-129F, once filed. I don't believe the advice you got either.

I take it your lawyer feels confident in her K3 process abilities and/or is counting on further fees for helping you with the AOS process as well.

Facts are cheap...knowing how to use them is precious...

I wouldn't hire a layer at all

The best help is here at VJ forum

I think 90 % of people here don't have a layer

No matter how the layer is experienced he can't help you with those backlogs that we are facing

When you look at the forms that we are using (ds-3032, Ds-230 , I-864 they only asking you simple question

You answer those questions to your layer anyway

He doesn't know those answers until you tell him

He only writes those answers in the form and takes money

And don't worry about scheduling an interview in Bosnia

It goes fast, once your spouse completes medical, they sometimes call them for interview even at earlier time, they are not so busy, it is a small country

At the end the CR1 way is cheaper then the the K3

Your husbands gets green card right away and SSN and permit to work

It takes longer, but it is much simpler

I was told on a call that they were going to administratively close my K-3. It was approved shortly after that.

I don't believe anything that call center says anymore.

I would hang in there if I was you
