Hi good morning everyone

A newbie here. Googling visas Visajourney came up. And what a relief it was.

My name is Kate and my fiance is Fateh from Algeria. We were recently engaged and we want to get married in the US. We are not clear if we want to live in the US yet; but I am leaning towrds it. After talking to several people we decided going for a K1 visa instead of *B visa would be best, since I am not sure if one can marry on a visitor visa.

So anyway; I started filling out the paperwork and I am stuck on a few small areas. I hope someone here has the time and info to help me.

What is Packet 1,2,3?

Reasons for denials?

How many proofs are needed to file the I129? It is minium? I have so far photos of us, tickets stubs, visas and letters from his friends

Does the petitioner and beneficiary have to write seperate cover letters ;like the letter of intent?

Affidavit support when do u send that?

Thanks Kate

And what is this RFE?

Posted (edited)

Hey there and welcome to visajourney!!

Packet 1 is the I129F that you will sent out along with the G325A and the supporting documents. Im not quite sure about packet 2 but packet 3 is mail from the us consulte in the foreign fiances country.

I still have all my stuff here, including a cover letter, so just ask if you have any questions!!

Oh, and RFE stands for request for further (?) evidence...in case uscis wants more evidence of an ongoing relationship

The Guides, located at the top of this website, are your friend. :) They contain all the information (and more) that you will need for this process.

To answer your immediate questions though:

Packet 3 is sent to your fiancé to fill out and send back once the NOA2 (approval of petition...NOT Visa) has been issued.

The reason for denial can depend on various reasons. I wouldn't worry about that (IMHO) at this point, although I am sure someone will come along to dispute this.

Proof of meeting within the last two years is critical. The Guides give you a whole list of things that you can submit to satisfy this requirement. Boarding passes, receipts, passport stamps, etc are all proof (depending on the dates of visits and receipts) that you have been with your fiancé *within* the last two years.

Petitioner and beneficiary write separate letters...well, at least most of us do. Some have successfully written ONE letter and both signed it and it was accepted.

The Affidavit of Support, the I-134 goes with your fiancé to the interview, once he has an interview scheduled.

As earlier stated, the RFE is for a request for more evidence, if what you have sent isn't enough.

I would seriously suggest that you read the Guides...they are your friend. :) Best wishes on the journey and don't be afraid to ask anything if you don't understand it.

Thank you again and GOOD LUCK TO both and all of you.

This is more than enough!

You are so good to go!!! :)

If you do get an RFE, simply send them back what they are asking for, it shouldn't put you behind more than a few weeks.

Don't forget to read through the Guides...they are in my opinion, the best resource on the internet on how to put the K1 package together.

Welcome to VJ and congrats on your journey!!!

Photos are good, but they are secondary evidence to satisfying the requirement of having met within the last two years. Ticket stubs, boarding passes, and such are more solid proof. Not sure of the letters from family or friends...we didn't send any. Our proof lay in proof of travel with dates and such.

A visa is not required for marriage in the USA. Any visa that will get him here will suffice for marriage but there is no assurance any visa will be issued.

A K1 visa is for marriage in the usa and immigratioin to live as a permanent resident in the USA.

What is not allowed is to use another kind of visa to enter, marry and then adjust status to permanent resident based on that marriage.

If you aren't sure you want to live in the USA, you're also not sure the K1 visa is appropriate for you.

I highly recommend the Guides and Immigration dictionary for questions like the others you asked.
