Risk of RFE??

Hello everyone,

A close friend of mine who has also been going through the horrible process of getting a CR-1 visa asked me to make a post for her and her husband. They're getting ready to send of their packet to remove conditions and are worried about getting an RFE due to lack of evidence. She asked me what I thought and since I haven't made it to the point of removing conditions yet I thought I would ask you guys.... So what do you think their chances of being approved are?

This is what they sent:

1. Joint tax returns for 2006 & 2007

2. Mail addressed to both sent to P.O. Box

3. Bank statement for joint account - established 1.5 year ago

4. Copy of rent, utility bills etc. - established 3 months ago

5. Car title & car insurance for the past 2 years

6. Husband's life insurance policy - established 1 year ago

I'll give this a try based on advice given to me. I'd say mostly because of the rent, utility bills etc being established such a short time ago and mail being sent to PO box JUST TO BE SAFE I'd send the affidavits of support from friends and a couple photos, in addition to what they have.

I agree with bettean, just have friends (you!!) write a letter about their marriage. Do they have anything else, maybe memberships? What about matching addresses on their driver's licenses?? Sams Club cars? Gym card??

They must have lived SOMEWHERE before three months ago--can't they submit evidence from past places of residence? If they were living with family, etc. then I think they should have whoever they were living with write an affidavit.

Thank you guys for your input.

Before they got their own place they were living with a family member. As far as I know they've asked that family member to write and affidaviat but the family member has refused. I think they said they didn't want to have anything to do with immigration - or something like that.

As for affidaviats from friends....I'll be the first to write one. And I'm sure they have pics, cards or some type of membership cards to add.

I'll make sure to pass the advice along.

If they're sending tax returns (and not tax transcripts), perhaps they should also send in W2s. If they have time, it would be better to request tax transcripts from IRS and send that in lieu of tax returns.
