What is best for me K1 or K3?

My fiance and I are weighing our options. Do we get married first and then file for the K3 or do we file K1 and wait? If we go the K3 route will it be easier for him to get a work visa once he is here? Will the wait time be shorter? Is there a difference between getting married in the UK and getting married in the US? Which one is better? What else should I be thinking about?

=)

You should be thinking about reading the guides first. There's no difference in getting a work visa between K1 and K3 but if you read in this forum, you'll find the K3 visa is in a state of uncertainty at best.

The CR1 is the other spouse visa. Using it, the immigrant spouse can work virtually upon arrival.

Neither. only CR-1 is the only visa that guarantees work authorization upon entry to the USA.

K-3 is not work authorized, so cannot get a JOB, SSN, or even a driver's license, untill they apply for and get EAD or Green-card. EAD takes 90+ days to get, AOS (Green-card) is costly $1010.

K-1 is similar, but is 90 day work auth primarily to be able to get SSN, some states are strict about requiring SSN for the Marriage license. In most cases K-1 cannot get a job either due to employers wanting EAD or green-card before employing.

CR-1 (I-130) only tends to take only slightly longer than K-3 due to additional processing at NVC.

IF work is a big factor in your plans, then apply for a true immigrant visa. (CR-1)

IF work is a big factor in your plans, then get married and petition for your spouse to have the priveledge to apply for a true immigrant visa. (CR-1)

Dan,

We've got far too many people referring to petitions as applications. It ends up confusing a lot of issues. Please don't contribute to the confusion.

That fee may be costly, but it makes sense. If you file I-485 and pay that fee, you don't need to pay a fee for the I-765 EAD document.

Put as a lump sum of the entire process. If I-485 (AOS) costs the same as in the past, you would still need to submit I-765 EAD with a fee. This adds uptogether too.

Oh. I thought you could get a SSN if the person has the I-94. However, the person may not use it for work.
