If for some chance we should get RFE'd on the AOS application, does that in any way affect the AP and EAD things as well?

Just curious....

08 JUN 2006.....AP document recieved :)

09 JUN 2006.....regular EAD approval

14 JUN 2006.....regular EAD recieved in mail

22 JUL 2006......AOS and EAD (?) touched...moving along maybe? :)

21 AUG 2006....Recieved interview letter!

26 SEP 2006.....INTERVIEW!!!!!!!!!!!!

26 SEP 2006.....APPROVED WITH FLYING COLORS!

05 OCT 2006....Welcome letter recieved

11 OCT 2006....THE CARD ARRIVES!!!!!!!!!!

15 SEP 2008.....Sent for removal of conditions

24 SEP 2008.....NOA for removal of conditions

10 MAR 2009....Transferred from VSC to CSC

22 MAY 2009.....REMOVAL OF CONDITIONS APPROVED!!!!!! :) Citizenship here we come!

I don't really think so, but I've read of cases where people went to the local office for EAD (after 90 days were up) and were told that 90 days are from the RFE response date.

Maybe others have better info.

09-02-2005 Applications for AOS, EAD, and AP received by MSC

10-21-2005 AOS fingerprint notice for 12-08-2005

11-07-2005 AP approved

12-05-2005 Infopass appt at San Jose office for interim EAD -- Refused, because it is already approved by MSC on 11-07-2005

12-07-2005 Attempt at interim EAD at San Francisco office -- no go. Back to San Jose, where CSO (chief station officer) tells they will contact MSC via email to request permission to issue interim EAD

12-08-2005 Biometrics for AOS and EAD. Having no EAD appt letter was no problem (used EAD NOA)

12-15-2005 EAD arrived in the mail

12-24-2005 Received interview letter; interview scheduled 03-01-2006

01-28-2006 Received replacement SSN card in married name (5 wks since application)

03-01-2006 AOS interview -- approved; received stamp in the passport

03-13-2006 Green card arrived in the mail

Not if you get it in right away. Not answering the RFE will delay the EAD. It happened to us. The RFE never got to us.

We received RFE for AOS after sending in both applications ( AOS and EAD ) at the same time. In the RFE letter, it states :

"You are ineligible for employment authorization pursuant to Title 8, Code of Federal Regulations, Part 274a.13(d) until ninety (90) days after the missing initial evidence is received."

Karen ( USA ) and Tony ( UK ) now both residing in USA!!

2/28/05- I-129F sent to TSC

7/29/05- Interview date- Approved!!!!!!!!!!!!!

10/06/05-Tony comes home to Tennessee!!!

10/08/05-WE'RE MARRIED!!! I love this man!

AOS/EAD/AP

11/26/05-filed for emergency AP

11/29/05-filed for AOS/EAD

03/07/06-online EAD approval

03/10/06-received EAD in post and passed driving test (Wow what a day)

07/26/06-AOS Interview---APPROVED!!!!!!

07/31/06-received 'Welcome to America' Letter

08/07/06-received Green card in post wooooooooohoooooooo

03/30/09-received approval to remove conditions!

An RFE on your AOS will delay your EAD, according to documentation; however, this has not held true in some cases. It'####### or miss with the USCIS!!!

the RFE didnt affect anything for us..

We were SUPPOSED to have received the RFE back in JAN.2005, and we never received it, but i applied for AP

in May 2005, and got it 2 mths later... even WITHOUT having responded to the RFE.
