What I'm wondering now (and this may already be the case for some countries..I have no idea on laws for most of them :blush: ) but :

In order to pass a medical here(for a visa, obviously) does a person from Mexico still have to be free of all of these things if they are legal in his/her country?

And, if yes, what do you think of that? I say if they are coming here, they SHOULD have to conform to the laws of THIS country so I can see it. On the other hand, I understand the other point of view too...why shouldn't it be in their system if it's a legal substance?

That said, I don't do drugs! :no: just curious as to what the law is...I would imagine, it's that the drugs still can't be in his/her system at the time of interview...but I don't know for certain...??

Interesting question. I don't know that they do routine drug testing for a visa but I don't really know.

Personally I think if it's legal there, then while they are in that country it shouldn't held against them. My reasoning is that until the visa is granted and they come to the US they are living under their own country's jurisdiction and as such are not breaking the law there, and since not yet in the US they aren't breaking US laws

I am sure I read on another immigration site that someones fiance was drug tested and denied(although, they pot was NOT legal where he came from)...but it was a long time ago so I could be wrong....trouble is if someone has tested postive for drug use, then the thought may be that they would attempt to continue taking in the US, where it remains a crime....therefore adding to the drug/crime 'problem'. Who knows.

Well, we have someone on this board whose fiance failed the medical for the same reason (and I'm not picking on that fiance in ANY way just for the record...it just brought the question to mind for me.) I can see not wanting that in the U.S., but it makes me wonder how 'they' can say it's a reason for a denial if it's actually legal in his/her country.Hmmmm...anyway, off to bed! :) M.

Just a thought. But I was wondering if it will make them want to stay in Mexico. :yes:

yes. You are complying to the requirements of the USA so other countries laws don't count.

I'm not sure if the fiance you all were referring to is Javier or someone else. If so, allow me to clarify (because I know the situation is confusing!!!) Javier did not test positive for any drug use. He tested negative. His denial was based on an admission alone of a "tasting" incident which in fact, by law, does not qualify as drug use (and in common sense, since typically drugs are "used" to get high, and not tasted, from which you gain no effect whatsoever). That's why we filed the Advisory Opinion-to show that the Consular Officer's decision was wrong, which in fact it was, if she was following the law as it is outlined in the Foreign Affairs Manual.

Don't let the sunshine spoil your rain...just stand up and COMPLAIN!

ummm...no.....I actually was quite clear that I read what I did on another site a long time ago....her fiance was from Jamaica....
