Hi,

There's not much info about this I could find, so I hope someone can help me, please. I know it is technically legal to to apply for a H-1B while K3 is in the pipeline and that they are independently adjudicated, but does anyone have any experience with it? I crossed the border from Canada on VWP recently, and mentioned to the Immigration Officer that I might have an employer who would sponsor me for H-1B - [i know, I know, WAY too much information, but he still let me in, so it was okay]. He was pleasant about it, but said he didn't think USCIS approved H-1Bs under those conditions very often.

I'm hoping he was misinformed. Can anyone tell me otherwise? We filed Oct 07, and our current timeline suggests I-130 fully approved in April 09, so we are looking at workarounds. My would-be-employer is kosher and above-board, he needs a worker and I fullfill all the crieteria, so I think I would ordinarily get the permit if I wasn't applying for residency. BEST of all, he's in the town where my wife lives, so all good!
