HI everyone,

YOur contributions to this topic is much well appreciated...thank you!

My case: I arrived in US September 2006 and my K3 expiration date is on SEpt 2008..I haven't filed any adjustment yet of my status since I arrived. Guess, i have a procrastination syndrome..hehhee.... Now, its summer and my grandpa is sick...i wanted to visit Philippines just for couple of days... Do you think I can go back to US after I visited Philippines? I wouldn't get in trouble going back to US then?

Second case: If i filed for Adjustment of Status...how long does it usually takes to wait for the greencard? and if I got the greencard...can I visit Philippines right away?

You can leave and re-enter the US using a current passport and unexpired K3 visa as many times as you wish. After the visa expires, you would need either a green card or visa extension.

I'd plan on 4 to 6 months for the green card but it is possible to take much longer. Once you have it, you can come and go as you please as long as you maintain your permanent resident status.

You can leave and re-enter the US using a current passport and unexpired K3 visa as many times as you wish. After the visa expires, you would need either a green card or visa extension.

You don't extend your visa. You should file for your AOS before your visa expires. When you file for AOS, you also file for EAD and AP. EAD will allow you to work if your visa expires before your AOS is approved. The AP will allow you to re-enter the US once your visa expires and your AOS is not yet approved.

08/20/08: TSC received N400

08/21/08: TSC cashed check

09/02/08: Received NOA...........Priority date: 08/20/08

..............................................Notice date : 08/22/08

09/02/08: Received Biometrics Notification

09/18/08: Biometrics completed - Charlotte DO

10/24/08: Received Interview Letter

12/08/08: Interview @ 1:00pm. APPROVED!

01/05/09: Oath Ceremony 10:00AM. Now officially a USC!!!

AP is advanced parole. That's the only option for those entering on a K1 visa but the K3 status can actually be extended through application.
