On the appropriate line dependant on the income source.... if you and your spouse both the same income source then you combine into one number

Only way I can claim my income is to pay taxes is on my canadian income..

no way in hell Im doing that..

also she cant claim our sons for child tax credit even though they qualify under everything it asks but at the end it says they are not eligible..

Not necessarily 100% true... look at form 2555 (I think)

Even though you are technically a non-resident alien, a non-resident alien spouse can by special exception declare themselves a resident alien for tax purposes......

thus form 2555 to get a credit for what you paid to Canada... but reality is that it may in fact not be benneficial for you to do this..

Yep.. do your taxes three ways. MFJ with your income excluded using 2555, MFJ with taking a foreign tax credit using 1116 on the taxes you paid to Canada, and filing as MFS for your spouse only. Don't forget to include your state taxes when figuring out what benefits.

Choose the option that works best to your benefit.

Regardless of your tax status (resident vs. non-resident) the child for 2007 would most likely only be a non-resident alien, because of that any benefits associated with claiming the child as a dependant simply are not available.

nope she doesnt qualify...

I just dont get..

she didnt work except for the month of december.. the kids are both US citizens.... I only lived with her from september-december.. Ive never masde any income in the US..
