Quana, I think for your situation the best thing to do is hire a lawyer. I know it can be costly but in the long run its worth it. Your ex sounds like an unreasonable person and because unfortunately you are still married and have no separation agreement to fall back on he can cause alot of problems for you if you deny him the kids.

I am not sure where you live, if I knew I could probably be more helpful. But I am from NY and here you can file a petition for an order of custody. If you can't afford a lawyer, the judge can appoint a lawyer at no charge.

But like others have said, a good start is to go to your local court's website, that should provide lots of information. They make have a link to affordable attorneys.

Please sxplain to me, how she can "still be married' and file for a K1. I think we are quoting some information that may not be correct.

A good judge will take some of that into context, Kimmy. When that is the situation, you work 4 jobs if you have to, to hire a GREAT lawyer.

My brother's ex dropped there son off (no clothes) NOTHING told the little boy to get out her car and rolled out. We had to call the police to make a report. Been calling her for 3 days now and no answer. My brother didn't even know she dropped him off until he got someone to let him in the apt. building and he came upstaris. What if my brother was not at home and this was 10:00pm. They're charging her with abandoment. He was outside for 20mins before someone let him in the building. What a wicked rass ooman. I can't wait to see her in court.

Oh, then she diffentialy need to have this situation tighten, before she venture into this new relationship. As we all know, this visa process is very stressful without adding any additional burden on your self.

My brother is a great father. She told him that she's had him for 8 years and she wants to enjoy the rest of her youthful years (even though she has a 4 year old). They've not been together since the birth of their son, but she keeps nagging and nagging for more child support and the court keeps denying it. Girl, I had to give him a bath 2 times because he was so filthy. I'd rather look like a beat up pair of watah boots than let my child look horrible.
