Dmartmar, out of her entire post, you pick the two lines that only you could ever pick out and attach to potential immigration fraud.

Right after I get my greencard, I plan to go back and see my own mother and father and my terminally ill Uncle. If I could I would go back now to see my Uncle, but he's not an immediate relative so I'm sol. Moreover, he kept it a secret for over a year.

There are such circumstances that are unforseen. She did say they kept this a secret from her. Cut her a break.

We tried to search on the internet about emergency numbers you can call for Immigration problems. I dont remember who told us, but maybe there's a number for emergencies. Where do you think i can find it? This is rediculous: the closest office is cleveland I wish i had lived somewhere else. We wrote the email to the representative already and since there are the elections on may 2nd he might help us out even more. Hopefully there are people tomorrow in the office, maybe I'll be lucky this time :(

Thanks everyone for your support I have no idea how much you are helping us

I did some searching for you, you might try visiting the cleveland office. I found this information on the link for them

Visiting Our Office:

Public Hours:

The Cleveland Office is open to the public from 8:00 AM - 4:00 PM, Monday, Tuesday, Thursday, and Friday. The office is closed on Wednesday, Saturday, Sunday and on Federal holidays. An appointment is needed to visit our office. Please schedule an appointment using our INFOPASS services.

Please check the Field Office Closings page for current information on office hours.

Walk-ins:

To speak with an Immigration Information Officer, you must make an appointment via the Internet at INFOPASS. You must bring the printout of your INFOPASS appointment and a photo ID with you. Walk-ins without appointments are limited to emergencies. Please note, without an appointment you may have to wait several hours before you are served by an Immigration Officer.

Additionally, I would not just email your representitive. Call their office first thing Monday Morning, you can normally find the phone number listed on their website. This way you can ensure you get all information needed to them, they might require an attending physicians statement for your mother to confirm this is a true request or other information. The offices normally will have someone who specializes in handling immigration issues that you can talk to and can act on your behalf or walk you through what steps you need to take.

My heart goes out to you. Take care of your Mom and solve the other problems as they come. I agree that you can probably get an emergency AP or possibly file for CR1 in Italy. It is also good advice to make an infopass, if possible to learn your options.

There is one thing that I don't understand though. You have 2 kidneys so it is not unusual for a family member to donate a kidney but you only have one liver. I don't think a living person can donate a liver. I have only heard of liver transplants from people that were declared brain dead. Are you sure you have correct information about the medical facts pertaining to your Moms illness?

My brother had liver cancer and one thing I learned from his battle is that the liver can regenerate itself.....so only part of a mathcing liver is needed for the transplant.....that being said, it is still risky to both parties...

I would try for the AP....just my .02cents worth today.

Mary K.

It would be cool if brain tissue could regenerate that easily

She wants me to get a GC and go to college; but how can I do it, knowing that she needs my help?

So did you marry a USC out of true love or for a GC? Your mother's well-being should take precedence over anything, including your AOS application, or so I would think. It's funny how right after AOS submissal you have to leave your household.

If you have poo, fling it now.

OP - Please do your best to make an infopass appointment, I know gas prices suck right now, but if you guys can find someone to lend you money for a ticket, gas shouldn't be that much of an issue. I hope everything works out

Denali not only you are a very ignorant person, but also very rude. I am surprised you didn't know that you can actually donate a portion of the liver....where have you been living all this time? Keep your opinion to yourself. If you relaly want to know I am not homesick, probably you are. I am probably "momworried" because my mom is dying if you can actually read english (which i doubt ). I don't think you need a degree in medicine to know these kind of things. Kathryn, I really appreciate your explanation. At least soomeone knows what I am talking about. Denali, why don't you go do a search before you talk next time? Maybe can enrich your culture....maybe....just don't jump to conclusion and insult people who are already suffering enough with your ignorant opinions that nobody cares about (read: ME). But I am not going to stay here arguing with a "I - know- everything" person. One more thing: my husband was going to buy a ticket with borrowed money. I hope you will experience the same situation someday sjoefl01

Hey!

Denali. never said those things to you. she only asked was it your aunt or you donating the liver.

and she appoligzed when she saw it was you. so i think this anger is directed at her for no reason. just like you dont want anyone saying bad against you- that has to go both ways right?

btw, its not good to wish this on anyone.

go head with the poo flinging..

dmartart or whatever yoru name is, you go accuse someone else. Did you see the date of my marriage????? april 27 2004. 2004 your stupid! We have been married for more than 2 years (which I don't think you ARE) and If I wanted the GC as you said I would have started the process right away (may 2004) and by now I would have already had the GC in my hand right here, right now. I wouldn't have left and gone live in Italy for a year and a half. We started our process on october 2005, a year and half after our marriage. Hello!!!!! Wake up!!!! If you don't knwo what you are talking about just shut up. Probably you got married for the GC. Before accusing people just think. What you said not only hurt me and my entire family (my husband) but it is also a very serious accuse. I hope you will have a little bit of respect, just enough to apologize to me to my husband. Thanks.

Anyways, I have been around all day long, trying to borrow some money for gas that way i can make an infopass. They told that with 20 bucks of gas we can go and come back no problem. I get the money and tomorrow I'll make this infopass that way we can try to talk to an officer. I don't wanna call the customer service, they don't know anything about these kind of situations. What do you think the officer might tell us? I cannot do AP because I simply don't have $200 right now. They told me (I have never done it before because I am on a K3 visa) you have to pay for the form and it is about $200. Is that true?

Oh my God, I even talked to my mom today. I don't wanna make her worried that's why i don't tell her that we are basically screwed. I think the infopass is the closest option we have so far. We also called the Ne philly representative's office yesterday. We explained the whole situation and this lady gave us another number to call. We called that numb and this lady talked to my husband about the situation but she said she didn't want to do anything over the phone. She said to write a letter/email that way she can make sure she won't lose any information. That's what she said. Then she gave us her email address and we wrote her an email yesterday. Do you think we should call her back?

Thanks guys, really thank you a lot!!!!

Maria, I would call just to make sure they received the email=). Good choice about the infopass appt. I'm not sure what the officer would say, but I'm hoping based on the circumstances that they can make some sort of exception. I'm guessing you're the only child, so you would make the best match for her, since half of your dna is hers. Just make sure to bring evidence of her condition, and how if you're there she will have a greater chance of survival.

Ignore the morons. Get emergency Ap then take it from there.

"The fact that we are here today to debate raising America’s debt limit is a sign of leadership failure. It is a sign that the U.S. Government can’t pay its own bills. It is a sign that we now depend on ongoing financial assistance from foreign countries to finance our Government’s reckless fiscal policies."

Maria my heart goes out to you for being in such a difficult situation. Only you know what is the best thing to do but the emergency parole I think is your best line of defence in your situation. If the immigration officers are not compassionate enough to see your situation with the proof of medical papers from your Mom's doctor, then I don't know what the world is coming to.

As for those of who who were quick as usual to jump to conclusions. Do your own bloody research first before acting like a self-jumped up little dictator. The liver CAN be transplanted. A portion is removed from the donor and in-vivo it regenerates and grows to full size successfully. I know because I attended god knows how many medical lectures at university and this was a topic that was covered. some of you people just think you are holier than thou and should be ashamed of yourselves. It takes a unique person to see through the eyes of others. Don't be so quick to jump to conclusions.

and for those of you who bitched about going back "home" when they got the green card.. well i'll be up front and honest. As soon as i get my gc in my hand and get this damn immigration ####### over with, i'll be on the first american airlines flight back to gatwick and belfast because i miss my family terribly and by the time i go, it will have been near a year since i will have seen them. Sorry, but i'm a human and have emotions and I bet that I'm not the only one here who misses their folks like hell and cant wait to see them again. I love my husband dearly and i love texas but my parents have done more for me than i could ever have asked and you bet that i'll be on the next aa flight back to see them.

Take a large, almost round, rotating sphere about 8000 miles in diameter, surround it with a murky, viscous atmosphere of gases mixed with water vapor, tilt its axis so it wobbles back and forth with respect to a source of heat and light, freeze it at both ends and roast it in the middle, cover most of its surface with liquid that constantly feeds vapor into the atmosphere as the sphere tosses billions of gallons up and down to the rhythmic pulling of a captive satellite and the sun. Then try to predict the conditions of that atmosphere over a small area within a 5 mile radius for a period of one to five days in advance!

here is some information from the USCIS website about Advance Parole

Aliens applying for advance parole on the basis of a pending application for adjustment of status must be approved for advance parole prior to leaving the United States in order to avoid the termination of their pending application for adjustment. Note: this does not apply to aliens who have applied to adjust to permanent resident status and who maintain H-1B (Specialty Worker) or L-1 (Intracompany Transferee) status, or their dependents, who have applied to adjust to permanent resident status and who have valid H-1B or L status and valid visas, V nonimmigrants who have a valid V nonimmigrant visa, are in valid V nonimmigrant status and have or obtain a valid V nonimmigrant visa before applying for readmission to the US, and K-3/4 nonimmigrants who have applied to adjust to permanent resident status and who have a valid K-3/4 nonimmigrant visa, are in valid K-3/4 nonimmigrant status and have or obtain a valid K-3/4 nonimmigrant visa before applying for readmission to the US.
Can I Travel Outside the United States?

If you are in K-3 or K-4 status, you may travel using your unexpired K-3/K-4 nonimmigrant visa to travel outside of the United States and return, even if you are applying for adjustment of status simultaneously.

If you think you will be away more than 6 months, or if you think your AOS interview will be within 6 months while you're away, then you really do need to talk to someone at the district office to get an extension. I believe as a K3 holder, you can be outside the US for up to 6 months without need of a re-entry permit, as long as your K3 is still valid when you return. Whoever it was at the mis-information line that said 2 weeks is on crack :P

Recovery from donation surgery can be as quick as 6 weeks, or as long as 4 months to return to full mobility and previous lifestyle. I know you'd like to stay with your Mother as long as possible, to ensure her recovery, but if your AOS application is still a worry, you probably can safely travel back to the US within 6 weeks.

Get to Cleveland any way you can (Greyhound bus is probably cheaper than gas) and find out exactly how long you can stay without jeopardizing your return.

I hope all turns out well. *hugs* My thoughts are with you.

thank goodness for you, Reba. You are the only one even close to giving maria the right information. I think the "6 months out" info is also incorrect. And the 'can't go for the IV because you've filed AOS' as well. In fact, maria is operating on total misinformation immigration-wise.

It's not at all obvious. The National Customer [Dis]service Center has earned the nickname 'Misinformation Line' for good reason. Your problem with being away for an extended period of time lies in that you may miss your AOS interview, since you're going down that path.

Consult with an immigration attorney. The anecdotal evidence indicates that trying to re-schedule AOS interviews can be hit or miss, and trying to straighten out the mess of a missed interview can be problematic. Having an immigration attorney 'on deck' to handle such a situation, should it arise, would allow you to concentrate on the medical situation.

.... Being on a K3 visa I can easily leave the country while my AOS is being processed, but obviously I cannot stay more than 6 months out of the USA otherwise the petition will be considered abandoned. When i called the national customer service they told me I can stay maximun 2 weeks. ...

Yeah you're right Yodrak. The only problem is that we don't have the money to pay for an Immigration Attorney (they want a lot of money), we barely have the money for gas to go to cleveland for the infopass. My husband's father works in a small railroad over here, very small. He gets free gas each time he needs it because he works for the reailroad and they use it to fill the trucks. We might be able to get gas for free too, for this time at least! We still have to talkt to him about it, see if he is gonna let us do it thta way we can go to Cleveland for free! I wish I could talk to an Immigration Lawyer because, at this point, that would be the best solution. I know that they sometimes give free consultation, we can try with that.

Does anybody know how long I can stay outside the US? I don't think six months...that would be a bless, believe me, but it's such a long time anf it seems strange they give you so much time to come back. I know that once you get the Visa, prior to your trip to the US, the visa is valid six months. Like I get the Visa in April and I have to enter the US within six months, so maximum october or I will lose the Visa and I will have to re-apply. But once you enter the US and you live while the AOS is processing, I don't think you can stay out for 6 months. Probably not 2 weeks like that lady in the phone told me, but probably a month. We have been checking the web site a lot (uscis) but we cannot find any info about it. I'm almost about to try to borrow some money for the tickets and get the hell out of here!!!!!!!!

One more time, thanks averyone for your precious help (F)(L)(L)(L)

They don't have money for the gas to Cleveland so an immigration attorney is not going to be easy! GO with the infopass appt Maria, right now this is your best option.
